Sivarasa telah diberi penghormatan merasmikan Mesyuarat Agung Tahunan, Rukun Tetangga, Vista Subang bersama dengan Ahli Majlis zon, Sdr Khairul Anuar.
Walaupun kawasan ini dianggap "kubu UMNO", namum, Sivarasa tidak menolak jemputan kerana beliau adalah wakil rakyat untuk semua warga kawasan Parlimen Subang dan berkhidmat untuk kepentingan semua tanpa mengira pemahaman politik individu.

“UMNO/BN yang sebenarnya yang melakukan penindasan terhadap penduduk Rumah Panjang Bunga Raya tempoh 1993 -2008.”

Dengan mengapikan isu rumah kos rendah untuk penduduk rumah panjang Bunga Raya di Subang, UMNO/BN sekali lagi mengambil kesempatan mencuba memperbodohkan rakyat dan mempermainkan emosi rakyat. Saya yakin penuh penduduk Subang tidak akan termakan oleh propaganda mereka.

Penduduk Subang tahu dan faham masalah penduduk rumah panjang Bunga Raya adalah masalah tinggalan dari zaman UMNO/BN memerintah negeri Selangor.

Pada tahun 1993, penduduk Kg Bunga Raya telah dipindahkan ke rumah panjang mereka di sana kerana tapak rumah asal mereka akan dibangunkan oleh Syarikat Sinar Fadzilat Sdn Bhd. UMNO/BN telah menjanjikan untuk membina rumah kos rendah di tapak bersebelahan dengan rumah panjang.

Malangnya selepas dua tahun, ini tidak berlaku dan sebaliknya tapak tersebut didirikan banglo-banglo mewah yang dimiliki antaranya oleh pemimpin-pemimpin BN tempatan.

Penduduk rumah panjang terpaksa terus tinggal dalam rumah sementara mereka yang semakin tahun menjadi semakin daif. Sepuluh tahun kemudian pada 2003, BN sekali lagi menjanjikan mereka pangsapuri kos rendah di Jalan Pluto yang akan dimajukan oleh pemaju kedua Unique Creation S/B.

Perjanjian jual-beli ditandatangani pada tahun 2003 dan projek dijangka siap dalam tahun 2004. Malangnya projek tersebut dibenarkan oleh UMNO/BN menjadi projek terbengkalai serupa dengan 140 projek terbengkalai lain di Selangor. Ratusan pembeli rumah kos rendah termasuk penduduk rumah panjang di Bunga Raya terpaksa terus menderita tanpa menerima rumah kos rendah mereka. Pemimpin UMNO/BN tempatan terus menetap dalam rumah banglo mewah mereka.

Penduduk-penduduk rumah panjang juga telah mendakwa bahawa RM 4500 wang pampasan yang patut dibayar kepada setiap keluarga oleh pemaju lama telah diambil oleh Pengerusi MIC Subang En N R Krishnan melalui bekas ADUN UMNO Mokhtar Dahlan. Saya difahamkan En Krishnan sekarang tinggal di sebuah banglo mewah di kawasan bersebelah Kg Bunga Raya.

Selepas 2004 penduduk-penduduk Rumah Panjang Bunga Raya dilupakan begitu sahaja oleh UMNO/BN seolah-olah mereka tidak wujud. Rumah panjang tersebut didirikan pada tahun 1993 dengan tujuan digunakan hanya untuk tempoh dua tahun namun penduduk terpaksa terus menetap disitu dalam keadaan daif sehingga hari ini.

Kesemua ini berlaku dalam zaman kegelapan UMNO/BN memerintah di Selangor. Walaupun hanya setahun mengambil alih pentadbiran di Selangor, Pakatan Rakyat mula mencari penyelesaian pada tahun 2009. Pemulihan projek perumahan terbengkalai khususnya yang melibatkan rumah kos rendah yang terhutang berjuta ringgit bukan satu perkara mudah. Namun, usaha memulihkan projek terbengkalai di Jalan Pluto oleh pemaju baru ECL Sdn Bhd yang melibatkan hampir 500 pembeli termasuk 57 keluarga daripada rumah panjang Bunga Raya telah dimulakan.

Isu-isu saperti tunggakan cukai tanah dan cukai taksiran berjumlah berjuta-juta ringgit oleh pemaju lama telah menyebabkan sedikit penangguhan masa untuk mengatasi masalah ini.

Saya bersama dengan YB Dr Nasir, ADUN Kota Damansara akan terus berbincang dengan EXCO Kerajaan Selangor YB Ir Iskandar Samad dan Menteri Besar Selangor untuk mempercepatkan penyelesaian masalah ini.

Jelas UMNO/BN kini amat gelisah kerana pemulihan projek terbengkalai di Jalan Pluto adalah dalam proces pelaksanaan oleh pihak ECL Sdn Bhd. Tiga blok rumah pangsapuri kos rendah dengan jumlah 480 unit akan disiapkan oleh mereka. Sekarang blok pertama telah dimulakan dan sudah hampir 70% siap. Masalah penduduk-penduduk Rumah Panjang Bunga Raya dan pembeli-pembeli lain akan diselesaikan dalam jangka masa yang diperlukan.

Selama 15 tahun ( 1993 - 2008 ) penghuni Rumah Panjang Bunga Raya telah dilupakan oleh pemerintahan UMNO/BN. Tapak tanah rumah kos rendah mereka yang asal telah diambil oleh pemimpin UMNO/BN dan didirikan rumah banglo. UMNO/BN sendirilah yang menindas penduduk Bunga Raya!

Tetap tiba-tiba pada hari Ahad 28hb Januari 2012, setiausaha politik Perdana Menteri Datuk Shafie Abdullah telah turun ke Bunga Raya dan membuat janji kepada penduduk bahawa BN akan menyiapkan rumah mereka selepas PRU 13 sekira mereka memerintah semula kerajaan Selangor.

Janji ini yang dibuat bagi pihak Perdana Menteri memang satu janji yang palsu dan tidak ikhlas! Kenapa tidak ikhlas? - sebab, untuk tempoh 15 tahun daripada tahun 1993 ke 2008 semasa memerintah Selangor dan Malaysia, UMNO/BN langsung tidak pernah peduli kepentingan penduduk rumah panjang Bunga Raya dan cuba selesaikan masalah perumahan mereka. Malah pemimpin BN sendiri telah ambil tanah asal yang diperuntukkan sebagai tapak rumah kos rendah dan menghancurkan segala harapan penduduk yang miskin untuk menerima rumah mereka.

Sebaliknya, Datuk Shafie Abdullah sepatutnya minta maaf kepada penduduk Bunga Raya dan ratusan pembeli rumah kos rendah atas penindasan yang telah dilakukan terhadap mereka oleh UMNO/BN.

    Pongal is a four day long harvest festival celebrated in Tamil Nadu, a    southern state of India. For as long as people have been planting and    gathering food, there has been some form of Harvest Festival. Pongal, one    of the most important popular Hindu festivals of the year. This four-day    festival of thanksgiving to nature takes its name from the Tamil word    meaning "to boil" and is held in the month of Thai    (January-February) during the season when rice and other cereals,    sugar-cane, and turmeric (an essential ingredient in Tamil cooking) are    harvested.
    Mid-January is an important time in the Tamil calendar. The harvest    festival, Pongal, falls typically on the 14th or the 15th of January and is    the quintessential `Tamil Festival'. Pongal is a harvest festival, a    traditional occasion for giving thanks to nature, for celebrating the life    cycles that give us grain. Tamilians say `Thai pirandhaal vazhi pirakkum',    and believe that knotty family problems will be solved with the advent of    the Tamil month Thai that begins on Pongal day. This is traditionally the    month of weddings. This is not a surprise in a largely agricultural    community -- the riches gained from a good harvest form the economic basis    for expensive family occasions like weddings.
    The First Day
    This first day is celebrated as Bhogi festival in honor of Lord Indra, the    supreme ruler of clouds that give rains. Homage is paid to Lord Indra for    the abundance of harvest, thereby bringing plenty and prosperity to the    land. Another ritual observed on this day is Bhogi Mantalu, when useless    household articles are thrown into a fire made of wood and cow-dung cakes.    Girls dance around the bonfire, singing songs in praise of the gods, the    spring and the harvest. The significance of the bonfire, in which is burnt    the agricultural wastes and firewood is to keep warm during the last lap of    winter.
    The Second Day
    On the second day of Pongal, the puja or act of ceremonial worship is    performed when rice is boiled in milk outdoors in a earthenware pot and is    then symbolically offered to the sun-god along with other oblations. All    people wear traditional dress and markings, and their is an interesting    ritual where husband and wife dispose off elegant ritual utensils specially    used for the puja. In the village, the Pongal ceremony is carried out more    simply but with the same devotion. In accordance with the appointed ritual    a turmeric plant is tied around the pot in which the rice will be boiled.    The offerings include the two sticks of sugar-cane in background and coconut    and bananas in the dish. A common feature of the puja, in addition to the    offerings, is the kolam, the auspicious design which is traditionally    traced in white lime powder before the house in the early morning after    bathing.
    The Third Day
    The third day is known as Mattu Pongal, the day of Pongal for cows.    Multi-colored beads, tinkling bells, sheaves of corn and flower garlands    are tied around the neck of the cattle and then are worshiped. They are fed    with Pongal and taken to the village centers. The resounding of their bells    attract the villagers as the young men race each other's cattle. The entire    atmosphere becomes festive and full of fun and revelry. Arati is performed    on them, so as to ward off the evil eye. According to a legend, once Shiva    asked his bull, Basava, to go to the earth and ask the mortals to have an    oil massage and bath every day and to eat once a month. Inadvertently,    Basava announced that everyone should eat daily and have an oil bath once a    month. This mistake enraged Shiva who then cursed Basava, banishing him to    live on the earth forever. He would have to plough the fields and help    people produce more food. Thus the association of this day with cattle.
    The Fourth Day
    The Fourth day is known as Knau or Kannum Pongal day. On this day, a    turmeric leaf is washed and is then placed on the ground. On this leaf are    placed, the left overs of sweet Pongal and Venn Pongal, ordinary rice as    well as rice colored red and yellow, betel leaves, betel nuts, two pieces    of sugarcane, turmeric leaves, and plantains. In Tamil Nadu women perform    this ritual before bathing in the morning. All the women, young and old, of    the house assemble in the courtyard. The rice is placed in the centre of    the leaf, while the women ask that the house and family of their brothers    should prosper. Arati is performed for the brothers with turmeric water,    limestone and rice, and this water is sprinkled on the kolam in front of    the house.

    Inspite of immense urbanization, the traditions and customs attached to the    harvest festival of Pongal has not diminished. Though the nature of these    tradition and customs has changed, the glitter of this festival has not    dimmed. The fast changing times notwithstanding, certain things do not    change. The way we celebrate the festivals, for instance. The festival of    Pongal captures the quintessence of south Indian culture in all its    entirety and traditional practices and customs continue to hold their own even    today.
    The spirit is alive and Pongal is still treated as a time to discard the    old and welcome the new. The new crop that is harvested is cooked and    offered to the Almighty. Celebrated for four days, the various traditions    and customs of this harvest festival are:
    Bhogi Pongal
    The first day of Pongal known as 'Bhogi Pongal' is a day for family    gathering and is dedicated to Lord Indra, the king of the deities and God    of the Clouds and Rains. Offerings are made to him to please him so that he    blesses us for the plentiful harvest. It is also the beginning of the New    Year according to the Malayalam calendar and before sunrise, a huge bonfire    of useless things in home is lit that is kept burning throughout the night.    All the time, boys beat little buffalo-hide drums known as 'Bhogi Kottus'.    The houses are then cleaned till they shine and are decorated with Kolams    painted using rice four. There are yellow pumpkin flowers are set in    cow-dung balls in the middle of these designs.
    Surya Pongal
    The second day of Pongal known as 'Surya Pongal' is dedicated to the Sun    God. The granaries are kept full on this day and Sun God with his rays are    painted on a plank as he is worshiped with the birth of the new auspicious    month of Thai.    Since the word 'Ponga' means 'to boil' representing plentiful and excess    yield, a special dish is cooked on this day in a new mud-pot that comes in    innovative shapes and have artistic designs on them called 'Pongapani'. The    special dish is called 'Sarkkarai Pongal' and is offered to Sun God with    sugarcane sticks. It is said that Lord Sundareshwar performed a miracle on    this day in the Madurai    temple and breathed life into a stone elephant who ate sugarcanes. One can    see the depiction of the event in the Meenakshi temple.
    Mattu Pongal
    The third day known as 'Mattu Pongal' is dedicated to the cattle as    cowherds and shepherds pay thanks to their cows and bulls, paint their    horns and cover them with shining metal caps. They are fed 'Pongal' and    tinkling bells are tied around their neck. Cattle races are conducted and    in the game called 'Manji Virattu' groups of young men chase running bulls.    Bull fights called 'Jallikattu' are also arranged at some places where    young men have to take the money bags tied to the horns of ferocious bulls    single-handedly and without the use of arms. Lord Ganesha and Goddess    Parvati are also worshiped on this day. At some other places, this day is    celebrated as Kanu Pongal when girls feed colored balls of cooked rice to    the birds and crows and pray for their brothers' happiness and that they    always remember them.
    Kaanum Pongal
    The fourth day is termed as Kaanum Pongal. On this day, people travel to    see other family members. On this day, the younger members of the family    pay homage to the elders, and the elders thank them by giving token money.    Another thing many do is leave food out on banana leaves for birds to take.    Many South Indian people will take the first bit of rice cooked in any    given day and set it outside for the crows to take, so this is not    necessarily a habit only for Pongal.

    Pongal is the only festival of Hindu that follows a solar calendar and is    celebrated on the fourteenth of January every year. Pongal has astronomical    significance: it marks the beginning of Uttarayana,    the Sun's movement northward for a six month period. In Hinduism,    Uttarayana is considered auspicious, as opposed to Dakshinaayana, or the    southern movement of the sun. All important events are scheduled during    this period. Makara Sankranthi    refers to the event of the Sun entering the zodiac sign of Makara or    Capricorn.
    In Hindu temples bells, drums, clarinets and conch shells herald the joyous    occasion of Pongal. To symbolize a bountiful harvest, rice is cooked in new    pots until they boil over. Some of the rituals performed in the temple    include the preparation of rice, the chanting of prayers and the offering    of vegetables, sugar cane and spices to the gods. Devotees then consume the    offerings to exonerate themselves of past sins.
    Pongal signals the end of the traditional farming season, giving farmers a    break from their monotonous routine. Farmers also perform puja to some    crops, signaling the end of the traditional farming season. It also sets    the pace for a series of festivals to follow in a calendar year. In fact,    four festivals are celebrated in Tamil Nadu for four consecutive days in    that week. 'Bogi' is    celebrated on January 13, 'Pongal'    on Jan 14, 'Maattuppongal' on    Jan 15, and 'Thiruvalluvar Day'    on Jan 16.
    The festival is celebrated for four days. On, the first day, Bhogi, the old    clothes and materials are thrown away and fired, marking the beginning of a    new life. The second day, the Pongal day, is celebrated by boiling fresh    milk early in the morning and allowing it to boil over the vessel - a    tradition that is the literal translation for Pongal. People also prepare    savories and sweets, visit each other's homes, and exchange greetings. The    third day, Mattu Pongal, is meant to offer thanks to the cows and    buffaloes, as they are used to plough the lands. On the last day, Kanum    Pongal, people go out to picnic.
    A festival called Jalli katthu    is held in Madurai    , Tiruchirapalli and Tanjavur,all in Tamil Nadu, on this day. Bundles of    money are tied to the horns of Pongal ferocious bulls which the villagers    try to retrieve. Everyone joins in the community meal, at which the food is    made of the freshly harvested grain. This day is named and celebrated as Tamiliar Thirunal in a fitting manner    through out Tamil Nadu.
    Thus, the harvest festival of Pongal symbolizes the veneration of the first    fruit. The crop is harvested only after a certain time of the year, and    cutting the crop before that time is strictly prohibited. Even though Pongal    was originally a festival for the farming community, today it is celebrated    by all. In south India,    all three days of Pongal are considered important. However, those south    Indians who have settled in the north usually celebrate only the second    day. Coinciding with Makara Sankranti    and Lohri of the north, it is    also called Pongal Sankranti.
    Meaning & Significance
    Thai Pongal is an occasion for family re-unions and get-together. Old    enmities, personal animosities and rivalries are forgotten. Estrangements    are healed and reconciliation effected.
    Indeed, Thai Pongal is a festival of freedom, peace, unity and compassion    crystallized in the last hymn on unity in the Indian spiritual text the Rig    Veda. Thus, love and peace are the central theme of Thai Pongal.

Raja Petra’s scurrilous and dishonest accusations

I refer to his comments on January 6 in the blog Malaysia Today titled “Just do it, not DUIT!” and the consequent report in the news portal Free Malaysia Today “RPK reveals cases of graft, power abuse in S’gor”.

Raja Petra’s comments show he is rapidly descending to the level of the likes of Nallakaruppan, Ezam and Zulkifly Nordin the way he is prepared to make completely unsubstantiated scurrilous and mischievous allegations.

He purports to produce what on the surface look like believable stories with flourishes of lurid detail. When you examine them closely, we find that key assertions are false. Other assertions remain simply that – pure allegations without evidence. However he is fully aware that the intent of his written comments is to attempt to damage reputations of individuals and smear PKR and Pakatan Rakyat.

Let me reproduce his allegations in respect of myself, Surendran, Derek Fernandez and Latheefa Koya. “Through the influence of Lateefa (sic) and Derrick (sic), a good chunk of the legal work in MBPJ is diverted to the firms of Sivarasa, Surendran and Derrick.” “legal work dished out by MBPJ legal department is given exclusively to a group of lawyers who are all PKR leaders”. “a large amount of legal work to these chosen few” . In one breath, he alleges “exclusivity” to these firms, and then contradictorily says “a good chunk” and “a large amount”.

He then suggests that this is corrupt practice or at the very least reflects a conflict of interest.

His assertions that Derek Fernandez and Surendran are doing work for MPBJ are completely false. He can’t even get Derek’s name and the name of the name of his firm correct. Derek Fernandez is not even a member of PKR.

Since 2009, my firm M/s Daim & Gamany have been retained by MBPJ to defend it in 4 cases. Two cases involved judicial review challenges brought by advertising companies unhappy with its new billboard policy. Two other cases involved a judicial review challenge initiated by a developer unhappy with stop work orders issued by MBPJ and a related civil suit. The firm is paid according to a scale of fees applicable to all firms retained by it. I believe there are about 14 firms on that list. 4 cases does not amount to the”large amount” or “a good chunk” or the “legal work dished out exclusively to PKR leaders” that Raja Petra alleges
I believe I am retained by MBPJ to defend it in these cases because judicial review is one of my areas of practice and as a lawyer of 24 years experience, they believe I am competent to defend their interest.

I have no executive role in MBPJ or in the Selangor State government. No question of any conflict of interest arises at all.

Similarly with Latheefa Koya. She practices as a legal assistant with Daim & Gamany. She is also a councillor of MBPJ. Hence she ensures she stays OUT of all meetings and decision making in respect of cases that are referred to my firm.

These issues about my firm receiving work from MBPJ and Latheefa’s role were raised two years ago by Wee Choo Keong after he left PKR. MBPJ clarified then that there was no conflict of interest on the part of Latheefa and myself. A simple check would have verified that.

Raja Petra insinuates scurrilously that I seem to have suddenly increased my personal wealth as a result of being given huge amounts of legal work by MBPJ. His evidence is “ Daim & Gamany has moved from their humble office in ‘slum’ Masjid India area to a new swank office near MBPJ.

Again, he has got it completely wrong. My firm was in PKNS Wisma Yakin in Jalan Masjid India up to 2005. In that year we moved to Megan Avenue II in Jalan Yap Kwan Seng. Then in May 2011, we moved to a smaller office in the Maris Brothers premises next to Catholic High School in section 10 PJ. We currently occupy office space in the form of 2 rooms about 300 sq ft each.

I say malevolent because these are matters that are simple to verify by any responsible writer and should have been verified before they were falsely and scurrilously published.

Many PKR lawyers are successful practitioners in their own right and are entitled to the income they generate for themselves in that capacity. What is Raja Petra’s motive in wilfully making such malicious accusations?

Raja Petra again lies when he says I am paid “tens of thousands a month” as a director on the board of Kumpulan Perangsang Selangor. I am certainly not paid “tens of thousands a month”. That would be immediately obvious from the published accounts of the company. I am paid the same as any other director. We are paid as professionals for the services we render on the board and in board committees for the responsibilities of helping to manage a public listed company with assets worth several billion ringgit; the amounts we are paid are similar to that paid in similar sized companies or possibly even less.

Look carefully at the allegations, insinuations and innuendo made against Azmin Ali without a shred of real evidence for something his brother has allegedly done. What is the intent here? Compare the way Rafizi produced documented fact after fact regarding Sharizat and the National Feedlot Corporation scandal. Raja Petra, if you have credible evidence of corruption in Selangor, produce it and I am sure Tan Sri Khalid and the PR leaders will deal with it.

Raja Petra has said subsequently as follows “PKR needs to prove me wrong. And if I am wrong then I will tender a public apology. Maybe my Deep Throats are wrong. Or maybe they intentionally set me up with a Red Herring.”

No. Petra, it is not so simple. You cannot get it so wrong and then wriggle out of it blaming someone else. As I said above, you maliciously knew it was false or were reckless as to whether it was false.

What you have done since your TV3 interview timed for release just before the 2011 Sarawak State Elections and your recent attacks timed for 1st January 2012 just before the 9th January Anwar verdict shows clearly now a malicious agenda with regard to PR and Anwar. Would you like to tell us in some detail what is your part of the deal?
What’s happening to you now is truly a pity. I still remember arguing for your freedom in the habeas corpus case we filed on your behalf in April 2001 after your first ISA arrest with Tian Chua and others.

It’s a timely reminder to us that along the difficult road we will all travel in our struggle and battle for justice and democracy that that there will be casualties. We will also have those who will betray the cause.

MENDESAK SUPAYA TANAH SEKOLAH – SRJK(T) EFFINGHAM – DIKEMBALIKAN OLEH MALAYSIAN INDIAN CONGRESS (MIC ) KEPADA PIHAK SEKOLAH

Isu SRJK Effingham merupakan suatu masalah penyelewengan besar berkaitan dengan tanah yang dihadapi di kawasan Parlimen Subang untuk satu tempoh masa yang agak lama.

2. Tanah seluas 6 ekar telah diperuntukkan kepada pihak sekolah oleh pemaju Bandar Utama iaitu See Hoy Chan Holdings Group mengikut peraturan dan dasar Kementerian Pelajaran dan juga peraturan perancangan bandar. Semua sekolah lain di kawasan yang dibangunakan oleh pemaju tersebut hari ini adalah di tapak sekurang-kurang 6 ekar.

3. Namun begitu, SRJK Effingham hanya didirikan dalam kawasan seluas 3 ekar.

4. Baki 3 ekar didapati dimiliki oleh Dato Seri Samy Vellu dan pemimpin MIC. Siasatan kami menunjukkan ini berlaku selepas pemimpin MIC telah memohon untuk dan mendapat tanah ini yang diperuntukkan untuk sekolah.

5. Saya menegaskan bahawa baki 3 ekar tanah sekolah tersebut yang dimiliki oleh Dato Seri Samy Vellu dan MIC wajib dikembalikan kepada pihak sekolah atas sebab – sebab berikut:

a) Sekolah Rendah sepatutnya mempunyai keluasan seluas 6 ekar mengikut dasar dan peraturan Kementerian Pelajaran tetapi SRJK Effingham hanya mempunyai 3 ekar.

b) Kawasan sekolah terlalu sempit di mana tiada pembaharuan untuk sekolah dapat dilakukan.

c) Waktu rehat adalah 2 sesi kerana ruang kantin tidak dapat menampung bilangan pelajar berehat pada waktu yang sama.

d) Bilik guru terlalu sempit. Seramai 34 tenaga pengajar terpaksa berkongsi bilik yang agak kecil.

e) Tempat letak kereta yang terhad disebabkan keluasan yang tidak mencukupi. Kebanyakkan tenaga pengajar menggunakan kereta menghadapi masalah untuk meletak kereta mereka.

f) Sebuah dewan sedang dirancang untuk dibina. Dewan ini akan dibina di atas kantin. Pada dasarnya pembinaan kantin sendiri tidaklah begitu memberangsangkan. Tambahan pula, pembinaan dewan di atas kantin adalah kerana keluasan 3 ekar untuk sekolah tersebut tidak mencukupi.

g) Kawasan padang adalah terhad. Pelajar tidak dapat berlari 100m seperti pelajar – pelajar lain kerana keluasan yang tidak mencukupi. Mereka hanya boleh berlari 75m dari hujung ke hujung padang.

Maka, sebab – sebab di atas wujud kerana keluasan tanah sekolah tersebut hanya 3 ekar. Jika sekolah itu mempunyai 6 ekar seperti sekolah sekolah lain, masalah – masalah seperti ini tidak akan wujud dan dapat dielakkan.

Saya, dengan tegasnya medesak bahawa Dato Seri Samy Vellu dan MIC kembalikan baki 3 ekar tanah untuk sekolah tersebut. Ini adalah kerana pelajar – pelajar sekolah tersebut memerlukan suasana pembelajaran yang sempurna seperti pelajar - pelajar di sekolah – sekolah lain.

Kami sanggup membayar balik kepada Dato Seri Samy Vellu dan MIC semua wang yang dibayar kepada Kerajaan Negeri Selangor untuk tanah 3 ekar tersebut.

Kami yakin masyarakat India dan semua rakyat Malaysia yang mencintai keadilan sanggup menyumbang dana untuk tujuan tersebut supaya mengekkan keadilan dan memperbetulkan satu penyelewengan besar.

PRESS RELEASE: Drop new politically motivated investigation against Anwar Ibrahim

We are disturbed and appalled that the police have commenced a new criminal investigation against opposition leader Datuk Seri Anwar Ibrahim. The federal opposition leader has been ordered to report for police interrogation at the Kepong police station for an investigation under s.182 of the Penal Code. This is a new and desperate attempt to prosecute and imprison Anwar Ibrahim, halt the movement for national political and economic reform and prevent Pakatan Rakyat from winning federal power in the coming general elections. Instead of engaging in legitimate political debate and discourse with the opposition, UMNO/BN is once again unlawfully using the police to fabricate criminal charges against Anwar Ibrahim. In previous unsuccesful attempts to silence Anwar Ibrahim in 1998 and 2008, UMNO/BN had also fabricated baseless criminal charges against Anwar Ibrahim with the complicity of the top police leadership and the Attorney General's chambers. In this regard, we have no confidence that Attorney General Gani Patail will exercise his powers fairly and impartially; serious allegations of fabrication of evidence by the AG against Anwar Ibrahim in 1998 made by former top cop Datuk Mat Zain Ibrahim remain unanswered. This political persecution of the national opposition leader by the corrupt use of law enforcement agencies is doing immense damage to Malaysia's international reputation; UMNO/BN is bringing our country down to the level of Assad's Syria or Egypt under Mubarak. We call upon the BN government, the Inspector General of Police and the Attorney General to immediately drop this latest politically-motivated investigation and cease all police and prosecutorial harassment and intimidation of the the opposition leader.

MACC IS CALLED TO INVESTIGATE ALLEGATIONS OF BRIBERY AND CORRUPTION BY MALAYSIAN BUSINESSMEN AND COMPANIES IN INDIA

We call on the Malaysian Anti-Corruption Commission to investigate T. Ananda Krishnan, Ralph Marshall, the majority shareholder and directors of Maxis Communication Berhad (“MCB”), Astro and other Malaysian entities relating to the investigation by India’s Central Bureau of Investigation relating to the ownership change in Aircel on charges of criminal conspiracy under the Indian Penal Code and Prevention of Corruption Act.

It is reported in the Indian newspapers and the local newspapers that the Indian authorities have filed a first information report against these persons and personalities in India relating to possible charges of conspiracy, abuse of power and bribery.

Sections 16 and 17 of the Malaysian Anti-Corruption Commission Act 2009 provide that the giving of gratification to any person or to an agent are offences. Section 66 of the Act provides that the MACC and the Malaysian Courts have jurisdiction to prosecute and convict Malaysian citizens and permanent residents who commit bribery and corruption in foreign countries.

It is imperative that the Malaysian authorities take action and to prosecute Malaysian citizens and permanent residents who have committed bribery and corruption offences in foreign countries to maintain the credibility and reputation of Malaysian businessmen and the Malaysian government.

“Najib memberi tapi dalam masa yang sama mengambil”

Dalam ucapan sambutan Hari Malaysia tadi malam, Perdana Menteri Datuk Sri Najib mengisytiharkan ayat berikut “ Suka saya mengumumkan pada malam yang bersejarah ini, Akta Keselamatan Dalam Negeri (ISA) akan dimansuhkan terus”.

Namun beliau secepatnya menambah bahawa “…dua undang-undang baru yang sesuai akan digubal di bawah semangat serta payung Perkara 149 Perlembagaan Persekutuan … untuk memelihara keamanan kesejahteraan dan kesentosaan serta kerukunan hidup rakyat dan negara”.

Ramai dikalangan kita mungkin tidak terus segera memahami makna yang tidak menyenangkan disebalik penggunaan perkataan “Perkara 149”. Perkara 149 merupakan bahagian jelek Perlembagaan yang membolehkan kewujudan Akta ISA sebagai undang-undang yang sah. Jika Perkara 149 tidak berada di sana, ISA dan kesemua undang-undang yang memperuntukkan penahanan tanpa bicara seperti Akta Dadah Berbahaya ( Langkah-langkah Pencegahan Khas) 1985 akan gugur kerana bercanggah dengan perlembagaan dan tidak sah.

Perkara 149 membenarkan undang-undang itu melanggar bahagian hak-hak asasi Perlembagaan seperti Perkara 5, 9 dan 10 yang menjamin perlindungan perbicaraan awam, antara perlindungannya, jadi dapat dikatakan ia sah diamalkan "di sisi undang-undang".

Justeru, apa yang dibuat Najib tadi malam? Dalam cara yang tidak jujur, beliau membuatkan sebahagian rakyat Malaysia berfikir bahawa beliau melakukan ‘tindakan bersejarah’ dan menghapuskan kejahatan ISA dan penahanan tanpa bicara selama-lamanya. Tiada satupun yang menepati kebenaran. Beliau melakukan silap mata. Sekarang anda nampak, sekarang anda tidak nampak!

Beliau tidak menjelaskan dengan tuntas bahawa penggubalan kedua-dua undang-undang baru di bawah Perkara 149 itu, sebenarnya mengembalikan semula penahanan tanpa bicara, walaupun kononnya dengan cara yang lebih lunak yang masih belum dapat dilihat lagi.

Dalam erti kata lain, beliau hanya menyatakan hasratnya untuk menghapuskan ISA dan mengembalikan ia semula dalam pakaian baru yang masih belum kita nampak. Ada udang disebalik batu, wajah yang sama bertopeng baru?

Frasa-frasa Najib saperti ‘transformasi politik’, ‘mengamalkan demokrasi yang berfungsi dan inklusif’ serta ‘menjadi negara maju yang sepenuhnya’ semuanya tidak bermakna apa-apa, jika rakyat Malaysia masih terus menderitai penahanan tanpa bicara dengan kuasa diberi kepada Menteri untuk mengeluarkan perintah tahanan selama-lamanya.

Walaupun Najib menyatakan kuasa Menteri untuk menahan akan hanya untuk 'keganasan', janganlah kita lupa pada penahanan Saari Sungib (sekarang ADUN Hulu Kelang), Tian Chua (sekarang Ahli Parlimen Batu), aktivis Hishamuddin Rais (sekarang bloger TukarTiub) dan 7 orang yang lain pada bulan April 2001 kononnya kerana mereka 'menyimpan pelancar roket dan bom Molotov koktail'. Suatu dakwaan bodoh (atas kebodohannya sendiri) tanpa bukti yang pernah dihasilkan dalam satu kenyataan akhbar bertulis yang dikeluarkan oleh tidak lain dan tidak bukan daripada Ketua Polis Negara Norian Mai. Begitu juga seperti hal yang berlaku baru-baru ini, Dr Kumar Devaraj (Ahli Parlimen Sg Siput) dan lima rakan-rakan beliau ditahan di bawah Ordinan Darurat (yang berfungsi sama seperti ISA) kerana didakwa menjadi sebahagian daripada anasir subversif komunis militan.Satu-satunya bukti keterangan hanya berpandukan beberapa helai t-shirt dengan wajah Che Guevara dan Abdullah CD, seseorang itu dapat membelinya dengan mudah di pasar Chow Kit.

Dalam erti kata lain, jaminan lisan Najib semata-mata bahawa tiada siapa yang akan ditahan kerana ideologi politik sebenarnya merupakan kenyataan kosong kerana anda dapat melihat dalam contoh yang diberikan tadi, pihak polis (dan memang Menteri pun) dengan mudah menuduh seseorang itu, khususnya ahli politik sebagai pengganas.

Jangan kita lupa, atas sebab inilah penahanan sewenang-wenangnya menjadi mercu tanda rejim-rejim zalim berpemerintahan kuku besi.

Najib membayangkan bahawa 'rangka perundangan khas yang digubal oleh negara-negara demokrasi yang maju seperti Amerika Syarikat dan United Kingdom untuk menangani keganasan adalah serupa dengan langkah-langkah kita yang sedia ada seperti ISA dan tahanan pencegahan. Ini memang merupakan kenyataaan yang mengelirukan.

Amerika Syarikat memperuntukkan kem tahanan Guantanamo Bay yang terkenal dan menjijikkan itu hanya kepada warga asing. Namun begitu, ia telah dikritik dengan meluas (dan benar) di selurung dunia kerana melanggar hak-hak asasi. Malaysia sebaliknya kerap mengurung dan menganiaya warga setianya sendiri tanpa bicara awam. Melihat kata-kata Najib, Barisan Nasional bercadang untuk terus berbuat demikian.

Undang-undang khas di United Kingdom hanya membenarkan mereka untuk menahan rakyat asing yang bermasalah yang jika dihantar pulang kembali ke negara asal mereka akan tertakluk kepada penyeksaan dan penahanan oleh pihak berkuasa di sana. Rakyat di UK tidak akan bertolak ansur untuk satu minit pun berkenaan apa yang kerajaan kita lakukan untuk rakyat kita sendiri atas nama ISA dan undang-undang yang serupa.

Pakatan Rakyat menyatakan pendirian secara bertulis dalam Buku Jingga kami. Kami berkata bahawa sebuah kerajaan persekutuan Pakatan Rakyat akan memansuhkan terus Akta Keselamatan Dalam Negeri (ISA) dan undang-undang lain yang membenarkan penahanan tanpa perbicaraan pada masa yang sama, membatalkan semua pengisytiharan darurat yang sedia ada.

Kami berpuas hati melihat Najib memutuskan untuk menerima pakai pandangan kami bahawa kita mesti membebaskan diri daripada pengisytiharan darurat masa lalu. Kewujudan berterusan pengisytiharan darurat tersebut telah menjadi sasaran ejekan di sini dan di luar negara khususnya kerana ketiadaan keadaan mirip darurat sekalipun di dalam negara selama beberapa dekad ini. Pakatan Rakyat pasti akan menyokong satu usul di Parlimen untuk membatalkan pengisytiharan darurat ini dan juga menggesa kesemua ordinan yang diluluskan dibawah pengisytiharan tersebut perlu dimansuhkan dengan serta-merta tanpa perlu menunggu tempoh 6 bulan seperti yang diperuntukkan dalam Perkara 150 (7).

Bagaimanapun kami amat jauh berbeza dengan Najib yang berhasrat untuk terus mengekalkan amalan jijik penahanan tanpa bicara yang tidak akan berlaku dalam era pentadbiran Pakatan Rakyat.

Malah, kami akan melaksanakan reformasi menyeluruh pasukan polis dan agensi-agensi keselamatan lainnya. Kami akan memastikan pasukan polis diberi kuasa yang mencukupi, latihan dan sumber bagi menjalankan tanggungjawab utama mereka mencegah jenayah dan mengekalkan ketenteraman awam secara profesional, cekap dan bebas, di samping menghormati hak-hak asasi rakyat.

“Najib giving with one hand and taking away with another”

In his Malaysia day speech last night, Prime Minister Najib declared in the following words “I would like to announce on this historic night, the Internal Security Act 1960 will be abolished”.

However he immediately went on to say that “… two new pieces of legislation will be formulated under Article 149 of the Federal Constitution … to maintain peace and well-being”.

Some of us may not have immediately understood the ominous meaning of the use of those words “Article 149”. Article 149 is the obnoxious part of the Constitution that allows the draconian ISA to exist as a valid law. If Article 149 were not there, the ISA and all other laws that provide for detention without trial in this country such as the Dangerous Drugs ( Special Preventive Measures) 1985 would be struck down as unconstitutional and void.

Article 149 allows such laws to violate the fundamental rights part of the Constitution such as Article 5, 9 and 10 which guarantee the protection of public trial, amongst other protections, and yet operate “legally”,so to speak.

So what did Najib really do yesterday night? In a disingenuous manner, he left some Malaysians thinking he was making a ‘historic move’ and ridding this country of the evil ISA and detention without trial for good. Nothing can be further from the truth. He was doing verbal sleight of hand. Now you see it, now you don’t!

He did not quite explain that with the two new laws to be formulated under Article 149, he would be in fact reinstating detention without trial, albeit supposedly in a more palatable fashion which is yet to be seen.

In other words, he only stated his intention to remove the ISA and reinstate it again in new clothes we are yet to see. The proverbial old wine in new bottle?

Platitudes about ‘political transformation’ and ‘practising functional and inclusive democracy’ and ‘becoming a full-fledged developed nation’ are meaningless if Malaysians are stlll to suffer detention with trial with power given to the Minister to order indefinite detention.

Even if Najib says that the power of the Minister to detain will be only for ‘terrorism’, let us not forget that the detention of Saari Sungib ( now ADUN Hulu Kelang), Tian Chua ( now Member of Parliament for Batu) , activist Hishamuddin Rais and 7 others in April 2001 were supposedly because they were ‘stockpiling grenade launchers and Molotov cocktails’. This foolish ( because of its inherent idiocy ) assertion for which no evidence was ever produced was in a written press statement issued then by none other than the Inspector –General of Police Norian Mai. Similarly and much more recently, Dr Kumar Devaraj ( Member of Parliament for Sg Siput) and five colleagues were detained under the EO ( which works exactly like the ISA ) for allegedly being part of militant subversive communism with the only evidence being some t-shirts with Che Guevara and Abdullah CD faces, which one could buy easily down in Chow Kit market.

In other words, Najib’s mere verbal assurances that no one will be detained for political ideology are in reality meaningless platitudes because as you can see in the two examples given earlier, the police ( and the Minister by extension ) can easily present anyone especially a politician as a terrorist.

Let us not forget that this is why arbitrary detention is the hall mark of oppressive despotic regimes.

Najib implies that the ‘special legislation’ formulated by advanced democratic nations such as the United States and the United Kingdom to handle terrorism is similar to the measures that we have had in place such as the ISA and preventive detention. This is downright misleading.

The United States reserves its obnoxious and notorious detention regime in Guantanomo Bay only for foreigners. Even then, it has been thoroughly ( and rightly ) criticized all over the world for violating fundamental rights. Malaysia on the other hand has regularly locked up and ill-treated its own loyal citizens without due process, and given Najib’s words, intends to continue to do so.

The special law in the United Kingdom only allows them to detain a problematic foreigner who if deported back to his country of origin will be subjected to torture and detention by the authorities there. Citizens in the UK would not tolerate for a minute what we do to our own people in the name of the ISA and similar laws.

Pakatan Rakyat’s position is set out in writing in our Buku Jingga. We said that a Pakatan federal government will abolish the Internal Security Act and other laws that allow for detention without trial while simultaneously rescinding all existing emergency declarations.

We are gratified to see that Najib has decided to adopt our view that we have to unshackle ourselves from the emergency declarations of the past. The continued existence of these declarations had long been an unfortunate target for mockery both here and overseas particularly because there was no semblance of an emergency like situation anywhere in the country for decades now. Pakatan will certainly support a resolution in Parliament to rescind these declarations and will also urge that all ordinances passed there under must also be annulled forthwith without waiting for the 6 month period provided for in Article 150(7).

However we part ways with Najib in his intention to maintain the repulsive practice of detention without trial which will no place in a new era of government under Pakatan Rakyat.

We will instead undertake comprehensive reform of our police force and other security agencies. We will ensure that our police force will be given sufficient powers, training and resources in order to carry out their primary responsibilities i.e. prevent crime and maintain public order professionally efficiently and independently whilst respecting the fundamental rights of our people.

1. Tuan R. Sivarasa [Subang] meminta Menteri Luar Negeri menyatakan, memandangkan keputusan terbaru daripada Mahkamah Tertinggi Australia berkaitan dengan perjanjian menghantar 4000 pelarian kepada Malaysiia, adakah Kerajaan bercadang untuk menandatangani Konvesyen Antarabangsa Pelarian 1951

Tuan R.Sivarasa [ Subang ] meminta Menteri Pertahanan menyatakan adakah ’komisyen’ tambahan selain daripada komisyen 114 .9 juta Euro dan juga ’komisyen’ 30 juta Euro dan 2.5 juta Euro yang dibayar kepada pihak-pihak lain termasuk Perimekar Sdn Bhd dan syarikat di Malta bernama Gifen yang berkaitan dengan pembelian kapal selam Scorpene.

3. Tuan R. Sivarasa [Subang] meminta Perdana Menteri memberikan unjuran pendapatan tahunan, kos penyelenggaraan, penambangan (ridership) dan harga tambang MRT dari tahun 2016 hingga 2020 dan juga menyatakan kenapa permintaan puluhan ribu penduduk untuk MRT dibena di bawah Tanah di kawasan Kota Damansara, Bandar Utama, Taman TTDI, seksyen 16, 17 PJ tidak dipedulikan

4. Tuan R. Sivarasa [Subang] meminta Menteri Pelajaran menyatakan kenapa untuk mata pelajaran Kesusasteraan Cina dan Tamil, di tahun 2010, tiada satu murid pun yang dapat gred A+, manakala 336 murid dapat A+ untuk mata pelajaran Kesusasteraan Melayu dan di tahun 2009, 134 murid dan 36 murid dapat A+ untuk Kesusasteraan Cina dan Tamil masing-masing

5. Tuan R.Sivarasa [ Subang ] meminta Perdana Menteri menyatakan sama ada kerajaan akan bercadang meminda Peraturan Mesyuarat Parlimen yang sedia ada untuk memastikan perjalanan semua jawatankuasa parlimen adalah terbuka kepada awam mengikut tradisi Parlimen Westminster dan parlimen moden dengan kuasa untuk mengadakan mesyuarat tertutup dalam keadaan yang istimewa ( special circumstances )

6. Tuan R.Sivarasa [ Subang ] meminta Menteri Kesihatan menyatakan hasil siasatan Jawatankuasa Siasatan (Investigation Committee) yang ditubuhkan oleh kementerian bagi menyiasat kes menembak gas pemedih mata dan menyebur air berkimia ke dalam kawasan Hospital Tung Shin pada 9 Julai 2011.

7. Tuan R.Sivarasa [Subang] meminta Menteri Pelajaran menyatakan samada Kerajaan Barisan Nasional bercadang mengambil balik tanah 3 ekar yang mulanya diperuntukkan untuk Sekolah Jenis Kebangsaan Tamil Effingham di Damansara Utama yang sekarang diambil oleh pemimpin MIC.

8. Tuan R.Sivarasa [Subang] meminta Menteri Luar Negeri menyatakan sama ada tindakan Ratu Queen Elizabeth II memakai baju kuning semasa Perdana Menteri menghadapnya di Istana Buckingham pada 14 Julai 2011 akan menjejaskan hubungan antara Malaysia dengan United Kingdom?

9. Tuan R.Sivarasa [Subang] meminta Menteri Kewangan menyatakan pelan kerajaan untuk membantu pesara menghadapi situasi inflasi menghakis keupayaan menabung kerana menurut Global Aging Report, hanya 21% rakyat Malaysia bersedia dari segi kewangan untuk persaraan.

BANJIR KILAT di kawasan Parlimen Subang

At all the programmes, YB Sivarasa was very warmly received by the crowd offering support and encouragement.

At these events, YB Sivarasa donated calligraphy done by a party member Sdr Lam which were auctioned to raise funds for the welfare / charitable organisation supported by the particular association.

711 SETTLERS FILE SUIT AGAINST FELDA FOR FRAUD & BREACH OF TRUST CLAIMING LOSSES OF UP TO RM344 MILLION RINGGIT

This morning at the Temerloh High Court, 711 FELDA settlers from 16 Rancangan Felda Jengka in Jengka Pahang through their solicitors M/s Daim & Gamany, filed a suit against FELDA (1st Defendant) and FELDA Palm Industries Sdn Bhd (2nd Defendant) for fraud and breach of trust.

The settlers were contractually bound by the 1st Defendant to exclusively deliver their oil palm yield (hasil sawit) to the 2nd Defendant and they have always been paid at a lower rate of the oil extraction grade (Oil Extraction Rate (“OER”) for the last 15 years – averaging at 18.5% as stated in the Akuan Penerimaan BTS i.e. the receipt that is given for each truck delivery of fruit bunches. There is no clear basis or information on how the 2nd Defendant came to these different rates which were given on a daily basis at the point of each delivery.

The settlers suspected something were amiss when they realised that they could never match the recommended rate from the Malaysian Palm Oil Board which was higher. In January 2010, the Federal Court ordered FELDA to pay 11 million ringgit in damages to settlers in the Kemahang 3 scheme in Kelantan for cheating them over the oil palm extraction rate.

The settlers through their representatives sent random samples of their fruit yields to independent laboratories to assess the actual rate of the OER. The results from the lab tests showed a much higher average rate of 27%. This would mean a difference of an average 8.5% over the rate used by the 2nd Defendant.

We have evidence to show that in the year of 2008, the 711 settlers from the 16 Rancangan Felda in Jengka had delivered at average yield of 120 metric ton per settler. The settlers were paid by FELDA the average price of RM560 per ton the same year. Using the figure of 8.5% lost to the settlers, FELDA has caused a loss of RM257.60 per ton which works out to about RM30,912.00 to each settler for the year 2008 alone.

FELDA has also deducted their fruit yields improperly by deducting an average of 200 kg per month for disqualified fruit bunches but they did not return the fruit bunches to the settlers. This led to a further loss of RM 560 x 2.4 or RM 1344 per year per settler or RM 14,333,760 for all the settlers over the 15 year claim period.

This means that over the last 15 years, FELDA has caused a loss to these 711 settlers to the tune of more than RM344 million.

Through this writ summons and the process of discovery in court, we will obtain the exact production figures for all the other schemes involved here to compute the exact loss over the claim period to the settlers.

The settlers are also claiming exemplary damages as they contend that FELDA, as the statutory authority set up by law to look after the welfare of the settlers has instead exploited its position of power and authority over the settlers and committed fraud and breach of trust.

Lembaga Kemajuan Tanah Persekutuan (Felda) berdepan dengan satu lagi saman - kali ini dari 711 peneroka rancangan Jengka, Pahang yang memfailkan saman RM344 juta berhubung dakwaan berlaku penipuan dan pecah amanah.Sebelum ini, Felda disaman oleh peneroka dari Kelantan, Johor dan Negeri Sembilan.

Saman tersebut difailkan di Mahkamah Tinggi Temerloh melalui peguam Ms Daim & Gamany yang diwakili oleh YB R. Sivarasa yang juga Ahli Parlimen Subang dan rakan-rakan pagi ini, dengan menamakan Felda dan Felda Palm Industries Sdn Bhd, sebagai defendan.

Dalam kenyataan tuntutan mereka, peneroka berkenaan mendakwa mereka terikat oleh Felda untuk hanya menghantar hasil kelapa sawit kepada Felda Palm Industries sahaja.

Mereka mendakwa sentiasa dibayar mengikut kadar perahan gred Kadar Perahan Asas (OER) sejak 15 tahun yang lalu - purata 18.5 peratus seperti yang dinyatakan dalam Akuan Penerimaan BTS - resit yang diberikan bagi setiap lori yang menghantar tandan buah sawit.

Peneroka berkenaan mendakwa tidak ada bukti jelas yang menunjukkan bagaimana Felda Palm Industries menetapkan kadar yang berbeza itu, yang diberikan setiap hari di setiap tempat penghantaran.

Peneroka mengesyaki ada sesuatu yang tidak kena apabila mereka menyedari yang mereka tidak mampu menyamai kadar lebih tinggi yang diperakukan oleh Lembaga Minyak Sawit Malaysia.

Peneroka, melalui wakil mereka, menghantar contoh rawak hasil buah kelapa sawit mereka kepada makmal bebas untuk menilai kadar sebenar OER.

Keputusan ujian makmal itu menunjukkan kadar purata lebih tinggi sebanyak 27 peratus, yang bermaksud perbezaan purata 8.5 peratus berbanding kadar yang digunakan oleh defendan kedua.

Peguam mendakwa mereka mempunyai bukti untuk menunjukkan bahawa pada 2008, 711 peneroka dari 16 rancangan Felda Jengka telah menghantar purata hasil 120 tan setiap seorang.

Peneroka terbabit dibayar oleh Felda pada purata harga RM560 setan pada tahun yang sama.

Dengan menggunakan angka kekurangan 8.5 peratus itu, Felda telah menyebabkan setiap peneroka kerugian RM257.60 setan, iaitu kira-kira RM30, 912 bagi tahun 2008 sahaja.

PRESS STATEMENT by YB R Sivarasa

I read with much concern the Bernama report yesterday of the statement issued by the Minister of Science, Technology and Innovation, Datuk Seri Dr Maximus Ongkili, on the radioactive contamination detected by the Atomic Energy Licensing Board (AELB ) in a factory in Selangor.

The statement said, amongst others, "the radiation reading on one of the workers exceeded more than 400 times the normal reading” and that AELB found that the reading at the factory was more than 100 times the normal reading.

Although the statement claims that the four workers have gone through the decontamination process and that the premises have been sealed, this is just not reassuring enough to the public.

In the light of the LYNAS issue, the transparency of the government on this matter is of utmost importance and be made top priority if they are indeed practicing “Rakyat didahulukan”.

Why did the government withhold information on this radiation leak for almost 2 weeks? This incident came to light on 2nd June 2011 when 4 workers from the factory were detected with high radiation levels after they had gone to the AELB office. However it was only on the 15thJune 2011 that the Minister released his short statement. By not being transparent immediately about this event, the BN Government is showing its disdain for the health and safety of Malaysians especially the people of Selangor.

By only releasing part of the information and only now, the BN Government has possibly jeopardized the health and safety of our citizens. This is irresponsible of the Minister who must take all responsibility for any consequences resulting from hiding the facts from the rakyat.

I demand that Datuk Seri Dr Maximus Ongkili immediately release full information including the name, location and nature of business of the factory involved. The Minister should also disclose the type of radiation involved, half-life etc and all other relevant facts. How did the mishap happen? What went wrong? Is there radiation still leaking? This is absolutely necessary to allay the fears of the public and to prevent unhealthy speculation by them.

Further to this the Minister must also make public all reports and results of the investigations that have been carried out. We must also be informed as to how the Ministry intends to ensure that such a mishap does not happen again.

Perayaan bermula dengan mengibarkan Jalur Gemilang, nyanyian lagu Negara-ku dan ucapan perasmian oleh YB Sivarasa. Ini diikuti dengan persembahan oleh kanak-kanak persatuan tersebut serta upacara doa untuk memberkati semua yang hadir dan mendoakan pendamaian untuk Malaysia.

Dalam ucapan perasmiannya, YB Sivarasa mengingatkan semua yang hadir mengenai tanggungjawab masing-masing untuk bersuara menuntut Keadilan untuk semua. Sepertimana dalam ajaran Gautama Buddha, apa yang kami lakukan sekarang hasilnya adalah untuk generasi yang akan datang.

Begitu juga, sekiranya kami pilih untuk berdiam diri, walaupun melihat ketidak adilan dalam masyarakat; maka anak cucu kami lah yang akan menerima padah nya.

Tunnel - Ara Damansara Traffic problem resolved

THOUSANDS of motorists were relieved because the Petaling Jaya City Council (MBPJ) did not close the FAS tunnel in Petaling Jaya Utara yesterday as planned but instead will turn it into a one-way traffic flow.

The council has accepted the suggestion of Ara Damansara residents of turning the two-way tunnel into a one-way flow to allow only traffic from the Damansara-Puchong Highway (LDP).

Traffic from Ara Damansara will now need to use the Megah Mas tunnel to exit into LDP.

The move is to also alleviate the suffering of residents in Taman Kelana Idaman, near the FAS tunnel.

What a relief: The missing link between Ara Damansara and Tropicana is finally ready.

The council was compelled to close the tunnel due to complaints from Taman Kelana Idaman residents who have to face the high volume of traffic right at their doorsteps every day.

It is hoped that turning the tunnel into a one-way flow and directing the traffic around Ara Damansara into one big loop will be a win-win situation for all stakeholders.

There is another reason for motorists to be happy because contractors appointed by the council had completed the major work on the missing link between Ara Damansara and Tropicana.

Work on road kerbs, markings and walkways are expected to complete by next Wednesday.

MBPJ councillor Khairul Anuar Ahmad Zainudin said the council had budgeted RM300,000 for the road but in the end needed to pay less.

“Traffic is so bad for Taman Kelana Idaman residents that they cannot come out from their houses. Heavy vehicles also zoom past daily and have even knocked down the height bars put up several times.

“We can imagine their frustration,” he added. He also advised FAS tunnel users to give way to residents when they need to exit from their houses.

“However, the problems faced by Ara Damansara residents are also real.

“MBPJ took note of their plight and discussed their recommendations with a traffic consultant.

“It was eventually agreed the tunnel be turned into a one-way flow and a set of traffic lights be installed at the cross junction to ease congestion,” he added.

Khairul said MBPJ would also build more road humps and a divider to prevent motorists from using Taman Kelana Idaman as a shortcut.

No date has been fixed for the implementation of the new traffic system.

Damansara resident Y.K. Lee expressed gratitude to the council on behalf of his neighbours for taking their feedback into consideration. He also thanked the councillor for his effort in trying to resolve the matter.

Keadilan menggesa Ketua Polis Negara untuk mendedahkan siapa yang dikenalpasti siasatan polis di belakang video seks 1999 ‘Siapa Anwar’

Dalam sebuah artikel yang diterbitkan hari ini dalam portal Internet “The Malaysian Insider” yang ditulis oleh Shannon Teoh, seorang bekas pegawai polis Dato’ Mat Zain Ibrahim mendedahkan sebuah video bertajuk ‘Siapa Anwar’ yang kononnya melibatkan Datuk Seri Anwar Ibrahim diedarkan di Kuala Lumpur beberapa hari sebelum Pilihan Raya Umum November 1999.

Laporan polis dibuat berkenaan video tersebut. Dato’ Mat Zain yang ketika itu mengetuai Jabatan Penyiasatan Jenayah, Kuala Lumpur memaklumkan bahawa siasatan dibuat berikutan laporan polis tersebut dan polis mengenalpasti sumber video seks 1999, tetapi tidak dapat mengenalpasti siapa di belakang video seks 1999 ini, tetapi tidak dapat mengenalpasti siapa di belakang pengederannya kepada orang ramai.

Beliau turut mencadangkan bahawa Tan Sri Rahim Ramy Chik mungkin dikaitkan dengan video yang muncul pada 1999, bermotifkan balas dendam terhadap Datuk Seri Anwar Ibrahim memandangkan Anwar telah membuat laporan polis pada 20 Ogos 1999 daripada penjara Sg Buluh terhadap Rahim yang menuduh tindakan jenayah dan rasuah oleh Rahim, hanya tiga bulan sebelum kemunculan video 1999 tersebut.

Kami mengambil maklum bahawa polis telah mendedahkan butir-butir mengenai siasatan video seks terkini secara aktif dan luar biasa pada tempoh-tempoh yang tertentu.

Parti Keadilan Rakyat menggesa Ketua Polis Negara,Tan Sri Haji Ismail Hj Omar, untuk memaklumkan kepada orang ramai siapakah yang dikenalpasti polis pada 1999 sebagai pihak dibelakang video seks 1999.

Keadilan calls upon IGP to reveal person/s identified by police investigation to be behind the 1999 sex video called “Siapa Anwar”

In an article today published in the internet news portal “The Malaysian Insider” written by Shannon Teoh and entitled “Another alleged sex tape of Anwar in 1999, says ex-cop”, the “ex-cop” Dato Mat Zain Ibrahim reveals ( or reminds us ) that a sex video entitled “Siapa Anwar “ purporting to be connected with Datuk Seri Anwar Ibrahim was distributed in Kuala Lumpur a few days before the November 1999 General Election.

Police reports were lodged in respect of the sex video. Dato Mat Zain who was at that time the OCCI, KL (heading the Department of Criminal Investigation, KL ) informs us that an investigation was conducted pursuant to those police reports and that the police identified the source of this 1999 sex video, but could not identify the persons who were behind its public distribution.

He also makes the suggestion that Tan Sri Rahim Tamby Chik may be connected to this sex video which emerged in November 1999 motivated by revenge against Datuk Seri Anwar Ibrahim as Anwar had made a police report on 20.8.1999 from Sg Buluh prison against Rahim alleging criminal and corrupt conduct by Rahim, just three months before the emergence of the 1999 video.

We note that the police have been actively and unusually revealing details of the current sex video investigation at regular intervals.

Parti Keadilan Rakyat calls upon the Inspector General of Police, Tan Sri Haji Ismail Hj Omar , to reveal to the public the “source” that was identified by the police in 1999 to be behind the 1999 sex video.

Keadilan also calls upon the IGP to inform the public as to what action was taken against the person/persons identified by the police as behind the 1999 sex video.

A Saturday for Sivarasa

Sivarasa started off the morning at Damansara Damai with the families of the senior citizens' who have recently passed away. The programme organised by the office of the State Assemblyperson of Bukit Lanjan, Penyelaras DUN Paya Jaras and Petaling District Office to hand out the balance payment of the RM2500 given by the Selangor State Government under the Skim Usia Mas programme of the Merakyatan Ekonomi Selangor initiative.

This was followed by a visit to a resident who was the victim of a motorcycle accident recently.

Following the visit to the accident victim, Sivarasa went on to Kg Kayu Ara to visit the site of a fire affecting 2 families and 4 homes. He also arranged for the temporary relief housing for the victims at the Kg Kayu Ara community hall.

All these visits completed the morning of a Member of Parliament on a Saturday.

Khamis 7hb April - YB Sivarasa bersama YB Dr Nasir telah turun ke Kg Baru Sg Buloh untuk perjumpaan bersama penduduk-penduduk tempatan dan Ketua Kampung Sdri Ho.
Tujuan perjumpaan adalah perundingan untuk menaik taraf jalan di kawasan tersebut.
Untuk manfaat yang lebih besar, Ketua Kampung Sdri Ho telah mencetuskan idea dimana pemilik-pemilik tanah dapat bekerjasama dengan pihak ADUN memberikan sumbangan untuk kerja naik taraf jalan.
Pemilik-pemilik tanah bersetuju membiayai kos keparitan dihadapan lot tanah mereka dan pihak ADUN bertanggungjawab untuk naik taraf jalan.
Kerjasama sebegini memang digalakkan dan YB Sivarasa turut memberikan sokongan beliau untuk cadangan ini.

Nursery operators want state govt to give TOL

ABOUT 50 nursery operators in Sungai Buloh are appealing to the Selangor government to grant them the Temporary Occupation Licence (TOL) which they have been requesting for the past two years.

A representative of the nursery opeartors, Lee Chee Chong, said they had complied with all the requirements that the local authorities needed for TOL.

Lee said the nursery operators were upset with the possibility of an organisation taking over their land and did not want a repeat of what happened previously when they paid a few hundred ringgit every month to the Selangor Agriculture Development Corpora-tion (PKPS) for the management of their nurseries.

“The nursery operators have invested a lot into their businesses over the past 10 years.

“We also want the TOL to be granted to us as a contribution for having built Sungai Buloh’s fame as a place for horticulture and landscaping resources,” he said.

The nursery operators will be submitting a letter to Mentri Besar Tan Sri Abdul Khalid Ibrahim to seek a meeting with him soon.

There have been talk recently that the Sungai Buloh nursery plots will be taken over and managed by Yayasan Selangor.

Kota Damansara assemblyman Dr Mohd Nasir Hashim held a meeting with the nursery operators to address the matter and discuss their next course of action.

“All the local authorities involved, including the District Office, Syabas, Public Works Department and Petaling Jaya City Council, have already agreed to approve the nursery operators’ applications for TOL.

“The District Office has even sent the paperwork on the TOL matter to the state government for its endorsement.”

Nasir subsequently wrote to Khalid to seek clarification.

“The MB then asked the District Office to respond to my letter.

“I later met two of the state executive councillors who said everyone have agreed to having Yayasan Selangor come in,” he said.

Re: Selangor’s Freedom of Information Enactment

I welcome the approval of the improved version of the Freedom of Information Enactment at the Selangor State Assembly sitting yesterday and congratulate the Selangor Pakatan Rakyat administration led by Tan Sri Khalid Ibrahim and in particular YB Elizabeth Wong and the FOI Select Committee of the Selangor DUN on a historic achievement. This is yet again another proof of the commitment of Pakatan Rakyat in fulfilling our election promises to the rakyat.

The FOI Enactment is concrete evidence of Pakatan’s commitment to democratic transparent and good governance. Pakatan Rakyat would be able to do much more in democratizing Malaysia if we were endowed with a mandate to govern at Federal level.

In the light of Pakatan Selangor’s historic achievement, at the next meeting of Parliament in June when I am allowed to reenter Parliament, I will retable the private member’s Freedom of Information Bill which I first presented in May 2008. Because of the current unfair system practiced by the BN in Parliament where opposition business including private members bills is not allocated any time, the Bill was not allowed to be discussed at all in the several occasions I presented it.

Now that the Selangor Pakatan Rakyat government has taken this initiative, I hope that Barisan National will respect the rights of the rakyat and allow the FOI bill to be debated in the Dewan Rakyat. Or, at the very least, there should be agreement to set up a Select Committee to oversee public consultation of the Bill in the manner the Selangor government has done.

Transparent and good governance are fundamental issues to be dealt with in our country. Slogans of transformation will be meaningless rhetoric unless substantive political reform such as the FOI legislation are also undertaken

Press statement by Sivarasa in response to Malaysian Insider article on “Eskay wants Anwar to reveal details of Thailand trips”

I refer to the Malaysian Insider article dated today entitled “Eskay wants Anwar to reveal details of Thailand trips”.

As legal counsel to Datuk Seri Anwar Ibrahim, I wish to warn Datuk Shazryl Eskay Abdullah that he should cease his foolish and childish rants about Anwar’s travels in Thailand or anywhere for that matter in the world.

No sensible person would deem it necessary to answer the sort of questions that Eskay is posturing with pretended bravado. Accordingly Datuk Seri Anwar has been advised not to respond to Eskay’s foolishness.

If Eskay has any specific accusations to make, then he should make them and meet the consequences, legal and otherwise.

Eskay seems to have the benefit of BN conferred immunity from criminal prosecution despite having openly committed the criminal offence of being in possession of an obscene video and also publicly screening it.

However any specific accusation that he chooses to make instead of these foolish vacuous questions will be met with the appropriate and stern legal riposte.

Lawmakers on both sides of the political divide demanded that newly-installed IGP Ismail Omar end the indiscriminate fatal police shootings. DAP advisor Lim Kit Siang declared: “It would appear that with the change of IGP, there is no change in the police culture as such.”

There was deep concern and consternation throughout 2010 over what the public viewed as the growing “shoot-to-kill” culture by the police force or what R. Sivarasa, the MP for Subang, called “a culture of impunity”.

“It means that they feel that they can do as they wish and they won’t be held accountable… they can shoot, kill, and there won’t be any questions asked (or)… any investigations and that they can continue doing so,” he said.

The nationwide concern over the trigger-happy cops of PDRM culminated into public outraged in April with the police “killing” of 14-year old Form III student Aminulrasyid Hamzah about 100 metres from his Shah Alam house.

The callous responses and cavalier attitude of the IGP, Home Minister and the police as they tried to contain the public firestorm caused the public to lose confidence in them and repeatedly call for the IGP to resign.

Respected lawyer Art Harun captured the sentiments of the people so clearly: “Right-minded people of Malaysia regard the killing of Aminulrasyid as symptomatic of lawless totalitarianism.”

“But that which makes this case all the more nauseating is not so much that this totally unnecessary killing of a 14-year-old boy had happened, but rather the responses by various parties — those people upon whom our security is entrusted — during the aftermath.

“The responses have been anything but humane, sensitive or even caring. They are arrogant, defensive and downright rude. Where is the love? Where is the humility? Doesn’t it occur to these people that they occupy seats of trust?”

Further, the police have become very predictable with their pat responses: “The dead were criminals. They behaved in a suspicious manner. They tried to evade/resist arrest. They drove away dangerously. Weapons were later found. Police acted by the rules. The law allows them to defend themselves” (Free Malaysia Today)

Cold Blooded

Seven months after Aminulrasyid was gunned down, three youths between the ages of 15 and 22 were shot dead after a reported high-speed car chase in Shah Alam. They were suspected of robbing a petrol station. Two of the families of the trio claimed that they were killed by the police in cold blood.

Lawmakers on both sides of the political divide demanded that newly-installed IGP Ismail Omar end the indiscriminate fatal police shootings. DAP advisor Lim Kit Siang declared: “It would appear that with the change of IGP, there is no change in the police culture as such.”

Before the year ended, human rights and legal reform advocates “Lawyers for Liberty” highlighted the seriousness of the situation. The number of fatal shootings by the police rose 17-fold since 2001 – from five in 2001 to a shocking total of 82 in 2008 and 88 in 2009.

Judging from Home Minister Hishammuddin Hussein’s curt, cold and caustic response, it is very clear that such “extrajudicial killings” will continue on in Bolehland! He said there was no surge in the number of fatal shootings. The matter was just being “sensationalized” in parliament. There could be a “slight increase” after all.

Hishammuddin’s continued his hogwash: “Let the police respond on the data …If not, I would be asked this question every day when there are other serious matters to respond to”. The data provided was from the police themselves! And what is more “serious” than the safety and security of innocent lives of Malaysians?

There were also those who were shot by the police but who managed to survive, the latest being Ho Chei Hang who was shot four times by plainclothes police officers in Kepong in November. The story of Norizan Salleh who was mistakenly shot five times by police officers last year continued to receive public attention in 2010.

It is evident that the only effective way to keep the police in check and the only convincing government action is the formation of the Independent Police Complaints and Misconduct Commission (IPCMC). Sadly, the federal government has proven to be a big hindrance to such a necessary move, and for obvious reasons

Sivarasa memberitahu Malaysiakini beliau mendarat pada jam 10.10 pagi dengan penerbangan AirAsia bersama ahli exco kerajaan negeri Selangor, Xavier Jayakumar.

Kedua-dua mereka ke Sarawak bagi menghadiri konvensyen PKR yang dijadualkan hari ini.

“Saya ditahan di kaunter imigresyen dan dimaklumkan bahawa terdapat masalah,” katanya.

Buat masa ini, Sivarasa ditahan di bilik pemeriksaan imigresyen di Lapangan Terbang Kucing dan dijangka akan dikenakan perintah halangan masuk.

“Mereka akan hantar saya balik ke Kuala Lumpur pada penerbangan seterusnya yang mempunyai tempat,” katanya.

Xavier, diiringi oleh isterinya dan seorang pembantu yang bagaimanapun dibenarkan masuk.

MRT bosses ignoring Pakatan MPs, says Siva

March 11, 2011 It appears that opposition representatives have no say in the project, even if the trains pass through their constituencies.

PETALING JAYA: Pakatan MPs are often left out of consultations on the proposed Mass Rapid Transit (MRT) system even though the trains will run through the areas they represent.

When they do respond to questions from opposition representatives, officials of the Land Public Transport Commission (SPAD) tend to give incomplete answers, according to Subang MP R Sivarasa of PKR.

Speaking to reporters here today, he said he was at a Petaling Jaya City Council (MBPJ) meeting in late January when SPAD officials dropped the MRT bombshell.

The attending SPAD officers raised the subject out of the blue, he said. “I was there for totally different reasons.”

The officers were accompanied by representatives of Gamuda-MMC, SPAD’s delivery partner in the MRT project. They needed MBPJ’s approval to build train stations in Petaling Jaya.

He said SPAD did not bother to call MPs and state assemblymen for the areas that the trains would pass through.

At least four of the proposed stations would be built in Sivarasa’s constituency.

He said the officials gave a presentation about the MRT proposal, but did not give satisfactory answers to questions posed afterwards.

“I asked them why stations were here and not there, and their answer was, ‘It’s because there’s another line coming from somewhere else,’” he said.

“That’s when I learned that there were other lines. So I asked them for the locations of the other lines, but they told me they didn’t have the information.”

He said he blew his top. “I said, ‘How do you expect us to understand your rationale when you’re not telling where your other line is?’

“This is the biggest project in the history of Malaysia, and you come to the public with partial info, and justify it with a half baked rationale.”

Sivarasa said the government needed to have more public consultations before going ahead with the controversial RM53 billion project.

Despite heavy public criticism against the MRT, the government appears determined to go ahead with it. It will call for tenders for various sub-contract works in April and award the contracts by June. Construction is expected to start in July.

Roads and drains to be repaired in new villages

ROADS and drains in Sungai Buloh New Village and Subang New Village will be repaired this year, Kota Damansara assemblyman Dr Mohd Nasir Hashim said.

Dr Nasir said he had identified the roads and drains in his constituency that need to be repaired or built under the Malaysian Road Records Information System (Marris) fund.

“I will be using the RM1mil fund channelled through the state government to several areas, particularly the two new villages,” he said.

In bad shape: This unnamed road that runs parallel to Jalan Welfare in the Sungai Buloh New Village will soon be rebuilt together with the drainage system.

The roads and drains identified for repairs are in Sungai Buloh New Village, Subang New Village, Kampung Melayu Subang, Subang Ehsan and Pekan Subang under the Shah Alam City Council.

In Petaling Jaya, the areas identified are Ara Damansara and PPRT (Hardcore Poor Housing Programme) Kota Damansara.

A 800m road that runs parallel to Jalan Welfare in the Sungai Buloh New Village, which is used as an alternative access to the town, is among those that will be upgraded.

According to villagers, the uneven and flood-prone road has not been repaired since it was built many years ago.

“My office has already submitted the proposal for the repair costs to the respective councils. We will be keeping track of the entire process to ensure everything is transparent and fair,” said Dr Nasir.

“The local councils will determine the cost of the projects by early next month and tenders will be called soon after that.

“We will also like to engage local contractors and have forwarded the list to the local councils,” he said.

Dr Nasir said if the allocated funds were insufficient he would request for more from next year’s Marris allocation.

He said state new village development and illegal factories committee chairman Ean Yong Hian Wah had also helped in getting similar repair work carried out in the new villages in 2009 and 2008.

Dr Nasir said he planned to negotiate with the Public Works Department for Jalan Kebun Teh in the Sungai Buloh New Village to be reopened as an alternative access for heavy vehicles to ease the daily congestion.

Sungai Buloh New Village resident Chong Fat, 47, said the condition of the roads and drains had worsened and hoped the authorities would look into creating additional access to the village.

THE Petaling Jaya City Council (MBPJ) spent much time drafting the Petaling Jaya Special Area Plan (RKK) but it is now said to go against the recommendations spelt out in the plan.

Residents of Ara Damansara found out the site for Ara Greens Wellness and Healthcare City project should have a plot ratio of 1:2 but the council had allowed 1:3.9.

The residents were also surprised to find out about the project’s conditional approval while it was agreed in the full board meeting in January the project was to be further reviewed.

They said another shocking find was that one of the blocks meant for service apartment later become a “hotel”.

A group of them visited the 3.24ha project site with Kota Damansara assemblyman Dr Mohd Nasir Hashim and Subang MP R. Sivarasa’s aide Peter Chong on Tuesday.

“The RKK recognises Jalan Lapangan Terbang Subang as a main road, development along the road can have a plot ratio of 1:4, and density should be reduced in accordance with its distance from the road and the LRT station. The project, as shown in this plan, should only have a plot ratio of 1:2,” said resident C.P. Lim, showing a print-out copy of the plan.

“The council has spent so much money commissioning the experts to come out with this plan, why are they not following it?” he asked.

He said the project had suddenly been changed to include a 180-room hotel, in place of the original service apartment with 180 units. The project will also include six blocks of medium-cost service apartments and one block of medical centre.

“The parking requirement will drastically change if they change the usage of the block from apartment to hotel. For service apartment, there must be 2.5 parking bays per unit and another 20% for visitors’ parking while hotel needs to have only one bay for every three rooms. Parking space will be reduced significantly,” Lim added.

The residents also highlighted that the site, as well as that of the adjacent proposed project named Lembah Penchala, was marked for recreational purpose in the Sime Pilmoor Development masterplan in 1995.

“Apart from the 5.3ha land, there were supposed to be two sites for secondary and primary schools but they are now occupied by a commercial area and an abandoned project. Where are the replacement sites? Why have the institutional land disappeared?” another resident Rajinderjit Singh said.

Lim pointed out that since the site was meant for recreational purpose, the utilities might not have enough capacity for such major development.

Chong said the council should explain as to why Form C, which means approval with condition, was issued to the developer while the council was supposed to review the project as requested by the full board.

“Once Form C is issued, all changes will need to be done at the state level, the council will no longer accept the appeals,” he said, adding there was a pressing need to look back at the minutes to find out what had happened.

Dr Nasir said he was also taken aback by the sudden changes in the development plan and questioned why the people were not consulted.

“We support development but there must be a balance. Development should not be done at the expense of the people,” he said.

On the other hand, a spokesman representing the developer clarified that the company did not have any intention to build a hotel.

“It could be miscommunication. The block is meant to be a service apartment, not a hotel” he said.

He added that the company was not aware whether the land was meant for recreational purposes but the current status was “commercial”, and the company had obtained conditional Development Order from the council.

As for the plot ratio, he said when the project was approved it was 1:3.9, and if a new plan had required the plot ratio to be changed, it should only be applied to future projects.

Pakatan Selangor’s support for Suhaimi is principled and correct

Comments made by Kedah Gerakan Youth Chief Tan Keng Liang and so-called “Gaps” Chairperson Hamidzun Khairuddin (see Malaysiakini 7.2.11) objecting to the PR Selangor government commitment to pay lawyers to defend PKR Seri Muda ADUN Suhaimi Shafiei in his sedition prosecution only show their lack of understanding on the duty of the state to ensure access to justice.

The most obvious reason for the Selangor government to give him financial support is the fact Suhaimi, a PR member of the Selangor State Assembly, is now facing a politically motivated prosecution under a draconian law initiated in colonial times to stifle free speech. On that score alone, PR Selangor, as a government advocating for a full democracy,would be duty bound to support his defence.

In the same way, there could be no objection whatsoever to PR Selangor giving similar support if some of the persons arrested during the Selangor organised gathering to hand over a memorandum rakyat to the Agung on the water standoff in Selangor were prosecuted for unlawful assemblyunder the Police Act, another BN draconian creation.

Likewise, if PR lawmakers in Selangor were suddenly arrested under the ISA (another draconian colonial creation) by the Federal Home Minister, there could be no objection whatsoever if PR Selangor weighed in with legal support for habeas corpus applications to secure their release. These are some examples to make the point

Simply put, the PR Selangor government is correct in principle to put its money where its mouth is and in principled opposition to politically motivated criminal prosecutions using oppressive laws.

The ignorant objectors we are hearing should appreciate that a civilised society goes even much further. Developed democracies all over the world put billions of dollars to fund legal aid systems and lawyers to defend their ordinary citizens facing criminal prosecutions for all sorts of ordinary criminal offences. This is to ensure a fundamental canon of justice – that access to justice is not denied because of a lack of means. Whenever matters of public interest are raised in court, these are also relevant considerations for the state to consider legal aid.

It is high time that the BN Federal government realised that the 25 million ringgit currently used annually to fund our existing pitiful legal aid system needs to be expanded many times over. We should be spending much more per capita to fund a truly effective legal aid system particularly for persons arrested and remanded in police lockups.

Countries like Australia, United Kingdom and Canada spend billions to deliver effective legal aid systems. Even after adjusting for the size of our GNP, our legal aid expenditure looks completely miserly and only serves to confirm our antipathy to a basic principle of justice. We should be spending hundreds on millions to ensure our citizens are ensure legal representation particularly for criminal prosecutions instead of spending billions buying military hardware of limited utility. It makes a mockery of the slogan ”Rakyat didahulukan”!

Whilst it is certainly not a responsibility of the state government under the Federal Constitution to provide full fledged legal aid systems which is afederal responsibility, it is my view that PR Selangor should consider initiating limited pilot public legal aid projects ( bearing in mind its limited resources ) to demonstrate PR’s commitment to full-fledged legal aid systems under a future PR Federal government. Access to justice must always remain a cornerstone of any equitable and fair legal system.

SUNGAI BULOH: Noise pollution and health risks from an illegal concrete-batching plant in Kampung Desa Aman here has got residents in the village all worked up.

Located just off Jalan Kuala Selangor heading towards Sungai Buloh, the village is already home to two other legitimate concrete-batching companies.

Rumbling cement mixers, heavy lorries transporting sand, cracked pavements, dusty surroundings and the noise pollution are proving to a bane to the residents.

The company, RMC Concrete Sdn Bhd, cleared off a large section of a forest in Desa Aman in August 2010 to build the plant without permit or approval of the Selayang Council (MPS).

Angry and upset over the brazen attitude of the company, the residents brought up the matter to MPS councillor Zulnizam Shahrani who visited the site today.

“This is a stupid development (pembangunan biadap),” said Zulnizam.

“The area was zoned for light industries, not one that involves a lot of lorries going back and forth.”

Zulnizam said one of the other two legitimate concrete-batching companies, Evermix Concrete, has agreed to relocate its business elsewhere by June this year and the permit for the other company would not be continued.

RMC Concrete Sdn Bhd had applied for planning permission for its site but it was rejected by Zulnizam at an MPS Local Centre Committee (OSC) meeting in early October.

Oddly enough, the permission was approved one week later at another OSC meeting.

Legal complications

Zulnizam, who was not invited to be a part of the second meeting, found out about this much later in the year. Permission was then again denied at a third OSC meeting in January 2010.

However, according to state law, the multiple rejections and approvals meant that the case had to be forwarded to the State Planning Committee (SPC) for further investigation.

Subang MP R Sivarasa, who also visited the village today, said that the OSC episode was unnecessary, and has now led to legal complications.

“If the MPS had done the proper thing, rejected the planning pemission and left it, we won’t have an issue, and today you could demolish the plant,” he said.

Sivarasa said that it was not clear why the second OSC meeting happened the way it did, leading to Kampung Desa Aman residents’ troubles.

In the meantime, RMC Concrete, went ahead and completed the plant early this year, much to the chagrin of the village folk.

“The residents have complained. They asked how work can still be going on when the planned permission at the OSC has been rejected,” said a frustated Sivarasa.

He pointed to different types of sand piled up at the back portion of the batching plant, waiting to be mixed into concrete.

MPS has issued a stop-work order to RMC Concrete Sdn Bhd. It is also in the process of bringing the company to court for illegal earthworks and building construction.

Until then, the council is unable to demolish the plant, and is currently waiting for the SPC to complete its investigation and get back to them

Re: Announcent by MBPJ on dismantling permanent barriers in guarded communities

I refer to the Malay Mail report : PJ residents given until March 31 to dismantle permanent barriers written by nurul huda jamaluddin dated Friday, January 21^st, 2011.

This report states that the Traffic Committee of Majlis Bandaraya Petaling Jaya has announced a 31 March deadline for implementation of new guidelines on barricades which may result in removal of some of the existing barricades put up by residents on some PJ roads.

I understand that what was not reported in the Malay Mail that the implementation of the decision is subject to getting feedback from ADUNS, MPs and RAs in the area of PJ. This decision will also need to be endorsed by the full monthly Council meeting of MBPJ before implementation.

I call upon MBPJ to put a hold on any implementation of this “new Guidelines” and maintain the status quo. The deadline of 31 March 2011 should also be removed immediately as it is causing much concern amongst affected PJ residents.

Whilst some of the barricades do breach existing laws such as the Street Drainage and Buildings Act, MBPJ decision makers including the Mayor and councilors must appreciate the root cause of the problem – i.e. the continuing failure of the Federal Government to provide security to the people in their homes and streets through a functioning police force.

Any response to the current situation MUST therefore take into account the security concerns of residents.

It would be more productive for MBPJ to press the Federal Government to relook at the rejection by the previous IGP of the proposal by MBPJ to employ 100 auxiliary policemen to improve security in PJ. MBPJ had already allocated 4.5 million ringgit to fund this.

I also call upon the new IGP to approve the request by MBPJ to appoint the new force of auxiliary policemen as soon as possible. The Minister of Home Affairs should also give this his urgent attention. The low number of police personnel in PJ is a key factor in the crime situation and must be addressed immediately.

Asking residents to dismantle barricades would be reasonable after measures to deal with the security issue are in place. In the meantime, if certain roads have been blocked unreasonably, then dialogues with the concerned residents should be initiated to resolve such disputes.

The recent repeated announcements by the Federal Government that the crime rate has reduced has not created confidence with residents that is the actual reality on the ground. Crime remains a serious concern.

MBPJ should immediately facilitate dialogues with the relevant RAs whose areas are considered not to be in compliance with the guidelines. RAs should be advised on the guidelines to follow with their existing boomgates. Each side should take one step back in order to move forward.

The concerns of the residents must also be given due consideration and not simply compliance with existing law. Perhaps a blanket ban on permanent structures is too simplistic an approach.

I would agree that barricades should not obstruct traffic especially for emergency services vehicles. Similarly, oil drums used in barricades and any other obstructions should not be a health hazard as breeding spots for Aedes mosquitoes.

If compliance with existing law is the concern of MBPJ, a discussion should be initiated as to what amendments are necessary to existing law to deal with the current reality on the ground.

With these compromises, the RAs of PJ and MBPJ can all work together positively to help make Petaling Jaya a safer and livable city.

Your 10 Questions for Sivarasa Rasiah

You have been detained under ISA twice. Yet, you have been undeterred in your opposition role. Don’t you fear at all that it could happen the third time? Kumar, Penang

This is a misunderstanding. I have never been arrested under the ISA although I believe I came close to being arrested in October 1987 during Operasi Lalang when a close friend, Yunus Ali who was staying in my home was arrested at my house under the ISA. I had to “volunteer” for an interrogation at that time to reduce the prospect of arrest.

I have been arrested though, a number of times under other laws such as the Police Act starting from 1996 when activists including Dr Kua Kia Soong and Dr Nasir Hashim and I were detained for a week in Dang Wangi lock-up.

Since my involvement in the “Reformasi” movement from 1998, I have been arrested again about 10 times and spent time in various police lock-ups on several occasions. I was also prosecuted three times for so-called “unlawful assembly”.

Thankfully, all the charges have been dismissed so far, although the prosecutors are appealing. I don’t discount the possibility of an ISA arrest happening though. As a human being, we can experience fear when facing police action.

But the prospect of arrest is an occupational hazard for activists in Malaysia who push the boundaries for reform. If one allowed a fear of arrest to prevail, we would not be able to do what we have to do. If personal freedom has to be sacrificed for the greater good, so be it.

How has your base of social activism helped in your role as a Member of Parliament (MP)? June, Seremban

My social activism since 1986 in Malaysia and in my student years earlier at Oxford and London is what has shaped and built the ideas, principles and political vision that I now carry with me and champion. Without my history of activism, I think I would have been a less interesting MP.

Of course, in my student and NGO days, one had the luxury and space of articulating principles and values in an idealised fashion and pushing for the limits, and which many of my colleagues and I did.

My involvement in the political movement since 1998 has brought a degree of pragmatism into my activism. I learnt that the oft quoted saying that “Politics is the art of the possible” is not an inaccurate statement. Also, dealing with grass roots concerns and widely differing views within the party and coalition posed a different set of challenges from dealing with networks of activists.

What led you to move into politics? Did you see the winds of change just before the March 2008 elections and felt that this would be a good time to embark into politics? Any regrets, so far? Sonia, Selangor

I got involved way before 2008. I would say that seeing the reaction and turbulence in our society to Datuk Seri Anwar Ibrahim’s arrest and detention and the birth of the Reformasi movement in September 1998 was the start of my direct involvement in politics. When the then largely Malay-based group of political activists decided that racial politics had no future and initiated what was to become the multi-racial Parti Keadilan Nasional in April 1999, me and a number of other social and human rights activists decided it was time to get directly involved.

I preferred, then, to join Parti Rakyat Malaysia whose leaders such as Syed Husin Ali and Sanusi Osman whom I had already supported in previous elections. Recognising that both parties would be strengthened by merger, many of us worked towards that objective which we achieved in 2003. Despite the setbacks we experienced in the 2004 elections when PKR went down to just one parliament seat, we persevered in our belief that this country needed a paradigm shift away from BN’s racial and authoritarian model. Our vision was and continues to be a multiracial platform espousing justice and fairness for all communities, affirmative action based on need not race, a genuine democracy with open and transparent governance. We believed that PKR with Anwar’s leadership had a key role to play in forging a coalition with PAS and DAP to provide a alternative to BN and to create the transition towards a two-party system in a democratic Malaysia. I believe that this is what the rakyat saw in March 2008 and which together with their growing rejection of BN resulted in the March 2008 political tsunami.

Regrets? I have none, whatsoever. I think we are in the middle of shaping Malaysia’s destiny and an exciting and truly challenging time in our history.

Did you almost choose a different career path and what was it? Gordon, Johor

Yes there was a time in my distant past when I hankered to become a doctor. It did not materialise and I know now that was God’s plan for me. In December 1979, when I successfully applied for the Rhodes Scholarship to study at Oxford, I made the decision to switch out of the field of genetics, which was my first degree.

Does your wife and family feel uneasy that what you do, as an activist and politician, could be risky? Sumathi, Penang

My wife Anne has been most supportive of my political work, because she shares the same values and beliefs. We met coincidentally at a demonstration in May 1987 in Ipoh Road which was organised as a citizen’s response to the brutal rape and murder of a nine-year old girl Ang May Hong. Operasi Lalang in October 1987 kind of threw us together.

Anne has spent many long hours and days in front of police stations with other friends and supporters, sometimes waiting patiently, sometimes pressing for my release. I have heard from friends that bullying police officers have occasionally scuttled away having experienced the lash of her angry tongue reacting to the injustices taking place in front of her. Really, I don’t think I could do what I have been doing without her.

What is it about Malaysian politics which you would most want to change? Annie Chew, PJ

What I, and most of us in Pakatan Rakyat are striving to do is to change the context in which our politics is played out. We want to change the reality of a 53-year continuing dictatorship by Barisan Nasional.

We want a truly democratic environment. We want free and fair elections. We want a level playing field, not just during elections but as a continuing environment in between elections. We want change that will benefit all stakeholders and players and even BN when one day, which is certainly destined, they become the opposition in Malaysia. We want to see our key institutions, the press, the judiciary, the police, the Election Commission, the AG’s Chambers, the MACC independent and professional. We want to entrench an environment where the government of the day knows that they can be replaced by an alternative that is also available to the rakyat. If we achieve that change of our political environment, then we will see our politics also changed for the better.

Do you think elections will be called next year and why? James Ong, Kuching

I think it will only be called at the end of next year at the earliest, and more likely to take place in 2012. I don’t think Umno/BN is ready for an early election and will only move in that direction if they do well in Sarawak. Given the trend in Sibu and the fact that the Dayak population of Sarawak are now restless because of threats to their Native Customary Land and issues connected to religion, the outcome in Sarawak is difficult to predict.

If true democracy is the government of the people, for the people, and by the people, what is your opinion about political leaders who are rejected by the people, yet come through the back door as Senators to become Ministers and party leaders? Dr M Raken, KL

If you look at a presidential system of government such as practiced in the US, France, Brazil, this is actually not a problem. You have an elected President who nominates unelected persons as a cabinet to manage the country. You also have a powerful elected legislature that acts as a real check and balance on the executive. No one says that this is not a democracy although I would say that the US form of democracy still has problematic features – it has not dealt with ownership of the media.

In the Westminster parliamentary system that we have inherited from the British, it is elected legislators who are nominated into an executive cabinet by the Prime Minister who commands the support of the majority of the elected legislators. So, if a Prime Minister wants to use someone who failed to get elected but who is perceived to have the necessary skills and experience, why is that such a problem? I am not convinced that it is one.

Political systems all over the world are evolving. Ours is too. We should not be too rigid in our approaches.

What is the biggest challenge you have faced personally, as well as professionally and what have you learnt from them? Stephenie Lao, Sepang

The biggest challenge I have faced professionally as a practising lawyer (since 1987) is the occasional challenge of arguing contentious cases before corrupt and/or spineless or self-serving judges. We learn that the case will not be judged on its merits as we have been taught in law school. We learn, however, that does not mean withdrawing from the battle. We go to court to present our arguments fairly and without fear or favour.

My biggest challenge, personally, was when I was diagnosed with thyroid cancer in April 2009. Because of the different types of cancer involved with different survival rates, there was a difficult one week waiting for the test outcomes. The operation also caused the loss of voice for almost a year – a difficult reality for a lawyer and a politician. However, I am thankful, I fully recovered my voice and my health. I feel that I have been blessed with a second chance at life.

It appears that there’s much back stabbing in PKR and the party is highly divided. How is it supposed to draw the voters in with such a perception? Generis, Kepong

I believe that much of these perceptions have resulted because of gross and continuous exaggerations in the BN-controlled mainstream media. On occasion, even falsehoods have been perpetuated of divisions when none exist.

The obvious fact that our leaders are never or rarely given their full right of reply with equal prominence speaks for itself. For example, when have you ever seen Anwar or Azizah or Syed Husin allowed to speak for several minutes on prime time national television? Just compare that with the media practice in our neighbours in Jakarta and Bangkok and Manila where the people get to hear all their political leaders regularly on prime-time television.

Having said that, we in the party must also take responsibility for the lack of discipline shown by some members who openly attack the party and its leaders. We need to handle discipline better.

Our strength lies in our multi-racial membership, our multi-racial leadership and the 17-point programme we have enshrined in our party constitution. We are the only truly national party in Malaysia today organised in all states and in almost all parliamentary constituencies. In our annual national Congress, you will see the diversity of Malaysia in substance not as tokens.

PRESS STATEMENT re Suspension from Parliament

Suspensions violate the rule of law and threaten the integrity and dignity of Parliament

The suspensions of the Leader of the Opposition, Datuk Seri Anwar Ibrahim ( Member for Permatang Pauh, Karpal Singh ( Member for Bukit Gelugor ), Azmin Ali ( Member for Gombak ) and myself are a flagrant violation of the rule of law.

The nature of these suspensions cannot be seen merely as actions to prevent us as individual members of Parliament from attending Parliament. The complete lack of any basis for the suspensions and the manner they were done threaten fundamentals of Parliament conventions and freedom of speech in Parliament. These are threats to all Malaysians, not just to the four of us.

The issues relating to the suspension of Anwar Ibrahim have been fully canvassed in the Minority Report of the Committee of Privileges written by myself and Karpal Singh ( see http://sivarasa.blogspot.com/2010/12/minority-report-presented-by-yb-karpal.html).

The most outrageous aspect of our four suspensions is the insistence by the BN majority in Parliament to not even accord us the fundamental right to be heard in our defence. In the case of Anwar Ibrahim, as fully explained in the Minority Report, the Speaker himself had repeatedly assured the House on 22.4.10 when the motion to refer Anwar to the Committee of Privileges that a full hearing would be accorded with all parties and witnesses heard. The Committee proceeded on this basis for its 1st three meetings on 17.5.10, 8.6.10 and 9.6.10. No meetings were called for another 6 months and then suddenly at the 4th meeting on 3.12.10, the BN majority members voted to decide the matter without hearing Anwar or any witnesses saying it was sufficient to decided the matter by reference to a letter from APCO dated 19.8.10 and contents of Hansard. Karpal and then withdrew in protest from the proceedings after this decision.

The refusal to hear Anwar Ibrahim shows without doubt the inability and fear of the BN majority to confront the facts and evidence that would have been produced before them by him.

Karpal Azmin and I are now suspended for 6 months for allegedly mentioning “evidence taken before and documents produced to the Committee” outside the House ( for Karpal and me ) and in respect of Azmin, in his urgent motion under Standing Order 18(1) on 6.12.10.

The motion to suspend uses the word “menyentuh” or “mention”. This is not what is prohibited under Standing Order 85 which only prohibits “publishing” or “menyiarkan” the evidence taken before or documents presented to the Committee.

Karpal and I had a press conference together with Datuk Seri Anwar at Parti Keadilan’s Headquarters at 2.30 pm to explain to the media the reason for our withdrawal from the proceedings of the Committee. As far as I was concerned, we were duty bound as members of the Committee and Parliament to do so. It was a matter of public interest to inform the public of the grossly unfair decision that the Committee had just made that morning and to explain our withdrawal.

We did not distribute the letter from APCO to the press nor did we disclose the details of its contents. We had, of course, to mention the fact of the letter from APCO in order to explain the decision of the Committee not to hear Anwar. Mentioning the fact of the letter in that context cannot at all be a breach of Standing Order 85.

A clause in one sentence of the letter was mentioned where the writer of the letter Brad Staples, the CEO of APCO falsely claimed that “he was not permitted to testify”. This was clearly false that because at no time did the Committee tell him that he would not be heard. Mentioning only that clause was relevant to the issue of the gross unfairness of the Committee deciding to proceed on the basis of that letter without hearing Anwar.

Similarly Azmin did not publish the contents of the APCO letter at any time either in his urgent motion itself or the short debate in the House.

Standing Order 85 is very clear. It only means that members of the Committee or Parliament cannot disclose ”evidence” given by witnesses. That does not arise here because the Committee had not even started hearing witnesses. As stated above, the contents of the letter were never published.

Standing Order 85 cannot be used to muzzle members of the Committee or the House from speaking about grossly unfair decisions of the Committee which are obvious matters of public interest.

When the Committee decided to disallow Anwar the right to be represented by legal counsel on 8.6.10 and also refused members of Parliament the right to observe the committee proceedings as done in other Parliaments, we also communicated this to the media. The BN majority led by Minister Nazri seemed to have no issue about this at that time. Somehow the letter from APCO seems to be a much more prickly issue!

The suspension of the Leader of the Opposition is clearly intended to silence his voice in Parliament raising the concerns of the rakyat whilst denouncing the corruption and misdeeds of UMNO/BN. parties.

Azmin’s, Karpal’s and my suspensions are similarly intended but are also petty minded acts of reprisal inflicted to punish us for persistently highlighting the gross unfairness in the proceedings of the Privileges Committee.

Our suspensions will prevent us from attending Parliament for the next 6 months but will not prevent us from discharging our duties to our constituents and the people of Malaysia.

I reiterate – these suspensions are not just about removing us as 4 individual members of Parliament. They represent BN’s desperate attempt to prevent the emergence of truth in Parliament proceedings. They have severely damaged the dignity and integrity of Parliament as an institution.

We will continue to take the message of these and other injustices to the people of Malaysia.

Beliau cuba membuat penjelasan dan meminta penjelasan daripada Yang Dipertua Speaker mengenai peraturan mesyuarat bersangkutan keputusan Speaker menolak Usul Tergempar yang dibawa beliau. Namun Speaker enggan memberi peluang kepada beliau untuk membuat demikian dan apabila YB Sivarasa cuba mempertahankan hak beliau sebagai Ahli Parlimen untuk bersuara, Speaker membuat keputusan untuk beliau digantung kehadiran dalam dewan selama sehari.

Pada 12hb Disember 2010, surat khabar Australia Sydney Morning Herald telah menerbitkan isu kandungan beberapa kabel-kabel sulit yang ditulis oleh pegawai kanan daripada State Department, Amerika Syarikat di 2008 dan 2009 yang dibocor kepada surat khabar tersebut secara eksklusif daripada laman web ”Wikileaks”. Kabel-kabel tersebut, antara lain, menerangkan kandongan perbualan diantara pegawai-pegawai Amerika Syarikat dan tiga pegawai kanan daripada Kementerian Luar Negeri Singapura bernama Peter Ho, Bilahari Kausikan dan Tommy Koh.
Antara kenyataan-kenyataan yang dilaporkan yang dibuat oleh Bilahari Kausikan dan Peter Ho adalah saperti yang disebut di atas.

Ada juga penerbitan di surat khabar tersebut yang berpunca daripada satu kabel pada November 2008 yang melapurkan perbualan di antara pegawai Amerika Syarikat dengan pegawai perisik Australia di mana pegawai Australia menceritakan pandangan pegawai perisik Singapura dan Menteri Kanan Lee Kuan Yew tentang tuduhan liwat terhadap Ketua Pembangkang Malaysia Datuk Seri Anwar Ibrahim.

Kenyataan-kenyataan tersebut di atas oleh En Kausikan dan En Peter Ho dengan jelas membawa maksud bahawa kedua-dua pegawai kanan Singapura tersebut mempercayai bahawa Perdana Menteri Najib adalah terbabit dalam skandal pembunuhan Altantuya Shaaribuu. Impak yang sangat berat kepada imej Perdana Menteri dan Malaysia tidak dapat dinafikan.

Setakat sekarang, kabel-kabel tersebut tidak dapat dikesan di dalam koleksi kabel-kabel yang telah didedahkan kepada umum di laman ”Wikileaks”. Ini bermaksud rakyat Malaysia masih tidak boleh menilai kandongan kabel-kabel ini secara terus dan memutuskan asas laporan di Sydney Morning Herald.

Oleh kerana tuduhan-tuduhan yang dibuat adalah sangat berat dan membangkitkan, pertamanya, perkaitan penglibatan Perdana Menteri dalam pembunuhan Altantuya dan, keduanya, kes liwat Ketua Pembangkang (kedua2nya pemimpin tertinggi negara), memang menjadi kepentingan negara untuk menghentikan perkara ini secepat mungkin dan mengelakkan spekulasi dengan mendapatkan kabel-kabel tersebut.

Saya berpendapat adalah wajar untuk Dewan yang Mulia ini membincangkan serta merta sama ada perlunya kita meminta jasa baik State Department Amerika Syarikat untuk mendedahkan semua kabel-kabel yang berkaitan Malaysia untuk tempoh berkenaan termasuk yang dipetik oleh Sydney Morning Herald.
Atas perkara yang tertentu ini yang melibatkan kepentingan rakyat umum yang perlu disegerakan, saya mohon usul ini dibincangkan.

Alarmed over 'extrajudicial killings' .

KUALA LUMPUR: Malaysian rights activists today demanded action over "horrifying" numbers of killings by police over the past decade, with the dead mostly Indonesians and ethnic Indians.

These are extrajudicial killings. The numbers are very significant. It is a major shock to us," R Sivarasa, a human rights lawyer and opposition lawmakers, told a press conference organised by leading rights group Suaram.

They cited police data produced during a recent trial that showed 279 alleged criminals were shot dead over a period of nine years from 2000. Nine people were killed by police in 2000 and the number surged to 88 in 2009.

"We are seeing a pervasive culture of impunity in the police force resulting in gross human rights violations. Those shot dead are called criminals," Sivarasa said.

He said that police typically defended their actions by stating that they tried to arrest the individuals but came under attack with machetes and that the suspect was shot dead in self-defence.

Of the 279 killed by police, 113 were Indonesian citizens, while 61 were ethnic Malaysian Indians and 42 were Malay Muslims – leading to charges that certain ethnic groups are particularly targeted.

A patrolman is currently on trial for the fatal shooting of a 15-year-old boy during a police car chase in April. Last month three youths aged 15 to 23 were shot dead following another car chase.

In all those cases police said they acted in self-defence.

N Surendran, an activist with Lawyers for Liberty, said police were too quick to open fire.

"There is a sense of shock and horror among the public. People are upset. Without a doubt the police force has members who are trigger-happy with a culture to shoot to kill," he told the press conference.

Surendran urged the government to intervene and "urgently put an end" to the deaths.

"We are shocked and horrified. The 279 deaths is an excessively high number," he said.

'Did my son beg for mercy before being shot?'Aidila Razak

12:26pmShare 11There is nothing that she wants more than to see the person who killed her child be hauled up to court to face justice.

But for now, Norhafizah Mad Razali (left in pix) just cannot help thinking of her son's last moments before he was shot dead by police.

"I keep thinking what he was thinking, how he felt before the fatal shot. Did he plead for mercy? Was he crying in pain?" she said in tears, while her husband, Shapiei Zainal Abidin who in spite of his own wet eyes tried to offer comfort.

Their son, Mohd Shamil Hafiz Shapiei, was shot dead about 4am on Nov 13 on a street in Glenmarie in Shah Alam, Selangor. He was about a week away from turning 16.

He was shot once in the chest and in the middle of his forehead, an image which will not leave his parents' minds.

"Call it a mother's instinct...I don't know how or why, but the words just slipped out of my mouth when I saw his body: 'He has been murdered'," she said when met at the low-cost flat where they live in Kota Damansara.

The police have claimed they fired in self-defence, as Mohd Shamil and two others - Mohd Hanafi Omar (right), 22 and Hairul Nizam Tuah, 20, said to be from Cheras - had allegedly charged at police with machetes after attempting to rob a petrol station.

All three sustained similar gunshots to the chest and head, with Hairul Nizam also shot at the side of his head while Mohd Hanafi was shot at the top of his head.

All the bullets passed through the bodies, with exit wounds on Hairul Nizam's body at a lower part of his head and torso compared to the entry wound.

Headlines immediately after the incident screamed 'Teen Terrorist', with reports quoting the police as saying that Mohd Shamil was a seasoned criminal and a ringleader of Geng Minyak- a gang that had been targeting petrol stations across the Klang Valley.

If the manner in which the youths were shot dead was not enough to raise their suspicion, it was the police statements which have steeled the families' resolve to get more answers.

Hairul Nizam's sister Norliza Tuah took her concerns to their parliamentarian R Sivarasa (left) of PKR.

"I kept thinking of the way he was shot. The trajectory of the bullet (evident from the wounds) makes it seem like he was shot from a higher point. Did the police climb a tree to shoot him?

"My brother was afraid of the police and refused to drive if he didn't have his driver's licence on him because he was afraid of getting caught. How could he have charged at police with a machete?

“And where is this machete? I want to see it. We have not been shown anything that was found on (the deceased) and the police kept asking us what colour his helmet is, but he left his helmet at the cyber cafe."

Fourth person involved?

The helmet and the keys to the Hairul Nizam's motorcycle had been passed to Norliza on the morning of Nov 13 by his friends who had waited for him to return to the nearby cyber cafe where they were.

The friends told her that Hairul Nizam and Mohd Hanafi were there at 3.30am that day when someone in a Proton Waja - she does not know who - stopped by the cyber cafe and invited them out for supper.

"(Hairul Nizam) asked his friends to wait for him and said he would be back in a short while. They waited until morning but he never came back," she said.

The last time Norhafizah saw her son was at around 2.30am, when he came to the tomyam stall which she operates next to the flats.

"He always hung around with other youths who live here and played checkers. His father saw him at around 3am," she said.

Although only 15, Mohd Hafiz had much time on his hands as he was no longer attending school, having dropped out of Tahfiz (religious) school last year.

Norhafizah said he was not academically inclined and that he had asked her to search for a place for him to take up vocational training.

The teen's absence was noticed early in the morning as he has not returned home - something he had never done before.

"His sister was receiving an award for academic excellence (on Nov 13) and he told me he wanted to go to the ceremony. I called him several times but his phone was turned off," she said.

No drugs or alcohol found

Answers, albeit vague, were found in the morgue of Tuanku Ampuan Rahimah Hospital, where forensic pathologist Khairul Azman Ibrahim informed them of their worst nightmare.

"We asked the police officer who was there to tell us more but he only said that he was not at the scene of the incident. No one could answer us properly," said Norliza.

But what they did find out was that none of the youths were under the influence of drugs or alcohol when they died, leaving question marks over why they would charge at armed officers with machetes.

Just like slain teen Aminulrasyid Amzah's (right)family, who had in vain sought an apology from the police for labelling the 14-year-old a criminal, these families too cannot fathom that the youths were involved in criminal activity.

Also on their minds is the identity of the mysterious fourth person in the Proton Waja, in which police said the youths had sped off.

“That is for the police to find out, I don't want to speculate. I just want justice for my son, for my children,” Norhaliza said.

Her second son has been taunted by his peers who have been telling him that his brother was a criminal, while her four-year-old is now asking his parents to buy him a gun.

“The little one keeps asking us where his brother is, and when we don't answer he says, 'He is dead, shot by police...police are bad',” she said.

More than clearing the name of their loved one, Hairul Nizam's family also wants this to be the case that changes the way police conduct operations.

“Someone has been charged in the Aminulrasyid case…(but) there is still something wrong with the system in which the police operate.If this could happen to our family, it could happen to another family too.

“Maybe the real Geng Minyak is still out there and my brother was the scapegoat,” Norliza (left in pix) said.

The family has since filed a police report about their suspicion over the shooting.
